# DC2024-05-0017 — Prescribing Amendments to Department Circular No. DC2020-06-0015, as Amended, or the Philippine Energy Labeling Program (PELP) Guidelines ## Department Circular No. DC2024-05-0017 Signed: 31 May 2024 by DOE Secretary Raphael P.M. Lotilla Effectivity: Fifteen (15) days following publication in at least two (2) newspapers of general circulation; filed with the UP Law Center - Office of the National Administrative Register --- ## WHEREAS RECITALS 1. RA 7638 (Department of Energy Act of 1992), as amended, Section 2 states State policy to ensure continuous, adequate, reliable, and economic energy supply through judicious conservation, renewal, and efficient utilization of energy. 2. RA 11285 (Energy Efficiency and Conservation Act, "EEC Act") declares government policy on energy efficiency, conservation, sufficiency, and sustainability. 3. EEC Act Section 5 designates DOE as lead agency for implementation, responsible for planning, formulation, development, implementation, enforcement, and monitoring of energy management policies and related EEC plans and programs. 4. Pursuant to EEC Act Sections 14, 15 and 36, DOE issued DC2020-06-0015 (Philippine Energy Labelling Program, "PELP Guidelines") and DC2020-06-0016 (Minimum Energy Performance for Products, "MEPP Guidelines"), mandating compliance of stakeholders in manufacturing, sale, and use of covered products. 5. There is a need to redefine the functions of specific DOE units under PELP Guidelines Section 4 for more efficient and streamlined EEC Act implementation. 6. MEPP Guidelines Section 4 provides an initial list of covered Energy Consuming Products (ECPs), expandable upon EUMB recommendation to the DOE Secretary. 7. MEPP Guidelines Section 8 provides for periodic adjustment of the MEPP and review of MEPP standards and MEPP-covered ECPs (Annex A, Table of MEPP), per Section 9, every three (3) years. 8. Pursuant to PELP Guidelines Section 10, as amended by DC2022-11-0035, the Technical Working Group reviewed the MEPP and MEPP-covered ECPs and recommended expansion and adjustment of Annex A (Table of MEPP), endorsed by EUMB for DOE Secretary approval. 9. Energy conservation and efficient utilization are major government strategies for energy self-sufficiency and reducing environmental impacts, per the Philippine Energy Plan (PEP) and DC2023-05-0018 (National Energy Efficiency and Conservation Program, NEECP). 10. DOE conducted public consultations on 29 November 2023 and 8 February 2024 with stakeholders from Luzon, Visayas, and Mindanao to present the draft circular and consolidate inputs. --- ## OPERATIVE PROVISIONS **Section 1. Amendments to the PELP Guidelines.** **1.1. Section 4.1 amended to read:** The Energy Utilization Management Bureau (EUMB) is responsible for formulation, promulgation, enforcement, review, and evaluation of PELP policy implementing monitoring activities to ensure industry compliance. EUMB discharges these functions through: - **4.1.1** The Alternative Fuels and Energy Technology Division (AFETD) — formulation, development, and updating of fuel efficiency testing guidelines and the Minimum Energy Performance for Transport Vehicles (MEPV), fuel economy performance, and other transport-related policies supporting the NEECP. - The Energy Efficiency and Conservation Program Management and Technology Promotion Division (EPMPD) — promotion and Information, Education, and Communication (IEC) campaign activities related to PELP. - The Energy Efficiency and Conservation Performance Regulation and Enforcement Division (EPRED) — formulation, development, and updating of the Minimum Energy Performance for Products (MEPP), Code of Practice on Energy Labeling of Products (COPE), development of on-site inspection guidelines, monitoring/verification/enforcement activities, and processing of Company Registration, Product Registration, and Energy Label Issuance applications in compliance with PELP. - **4.1.4** The Energy Efficiency and Conservation Public Sector Management Division (EPSMD) — promotion and IEC activities targeting the public sector. **1.2. Section 5 amended to read:** **Section 5. Covered Energy Consuming Products.** Under this Department Circular, the PELP covers the ECPs provided under Annex B (Matrix of Covered ECPs); provided, that additional ECPs may be included within the coverage of the PELP upon the recommendation of the EUMB. **1.3. Third paragraph of Section 10 amended to read:** EPRED shall be the convener of the Technical Working Group (TWG) for the development and formulation of the Product Performance Requirements (PPRs), technical requirements, conformity assessment procedures, and recognition of testing laboratories. **Section 2. Repealing Clause.** Provisions of other circulars, orders, issuances, rules, and regulations inconsistent with this DC are repealed, amended, modified, or superseded accordingly. **Section 3. Separability Clause.** If any section or provision is declared unconstitutional or invalid, unaffected parts remain in full force and effect. **Section 4. Effectivity.** Takes effect fifteen (15) days following publication in at least two (2) newspapers of general circulation. Foot spa machine **Information and Communication Technology (ICT) Equipment** — ECPs used for instructing, communicating with, storing data in, retrieving data from, or otherwise making use of any resources of a computer system or communication network, including devices with data processing capabilities like mobile phones and smart phones: 1. Energy Saving Devices 2. Uninterruptible Power Supply (UPS) 3. Auto Voltage Regulator (AVR) 4. Fire Detection & Alarm System 5. Public Address and Background Music 6. Portable Power Stations 7.
