## WHEREAS RECITALS

1. Section 2 of Republic Act No. 9136, otherwise known as the Electric Power Industry Reform Act of 2001 (EPIRA), declared as the policy of the State to ensure the quality, reliability, security and affordability of the supply of electric power.

2. Section 37 of the EPIRA further mandates the Department of Energy (DOE) to supervise the restructuring of the electricity industry, and in addition thereto, to "formulate policies for the planning and implementation of a comprehensive program for the efficient supply and economical use of energy consistent with the approved national economic plan and with the policies on environmental protection and conservation and maintenance of ecological balance, and provide a mechanism for the integration, rationalization, and coordination of the various energy programs of the Government."

3. Section 9 of the EPIRA provided that all generation facilities connected, directly or indirectly, to the transmission system shall be subject to central dispatch of the grid operator, subject to technical constraints, in accordance with the dispatch schedule submitted by the Market Operator (MO) and taking into account existing bilateral contracts.

4. Section 2 of Department Circular No. DC2017-05-0009, entitled "Declaring the Launch of the WESM in Mindanao and Providing for Transition Guidelines," which took effect on 26 June 2017, states that "All Embedded Generators (a) with installed capacity of at least 5 MW; (b) with installed capacity below 5 MW that have a contract outside its host DU, or intends to sell to the WESM, or inject power to the Grid; and (c) all Feed-in-Tariff ("FIT") eligible RE plants shall be registered in the WESM."

5. The Electric Power Industry Participants raised several issues on the treatment of Embedded Generators (EGs) in terms of licensing, connection and operational requirements, market registration, dispatch, ancillary service provision and metering service requirements.

6. The DOE, cognizant of the need to address any policy gaps and ensure optimal utilization of EGs in the Philippines, conducted review of all relevant policies and guidelines and existing practices in other jurisdictions and presented to focus group discussions (FGDs) its concept paper containing its recommendations, on the following dates and venues *(OCR note: the first date is garbled — see below)*:

   - [illegible: OCR reads "92 May 2018"; a two-digit day of month is expected given the following entries' format, but the document does not otherwise state which day] — The Mansion Hotel, Iloilo City
   - 30 May 2018 — Quest Hotel, Clark Pampanga
   - 13 June 2018 — The Greenleaf Hotel, General Santos City
   - 25 June 2018 — Cebu Parklane International Hotel, Cebu City

7. The DOE, in consideration of the inputs gathered during the FGDs, formulated a draft circular providing for policies on embedded generators, which was subjected to public consultations on the following dates and venues:

   - 30 August 2018 — Ace Hotel and Suites, Pasig City
   - 20 September 2018 — N Hotel, Cagayan de Oro City

NOW, THEREFORE, pursuant to its authority and mandate under the EPIRA and its Implementing Rules and Regulations (IRR), and after due consideration of the inputs from various stakeholders, the DOE hereby issues, adopts and promulgates the following:

*(OCR note: this section's five top-level numeral tags — 6.1 through 6.5 — were extracted together, ahead of their five corresponding paragraphs, evidently a column-layout reading-order artifact. The count of tags (5) matches the count of untagged paragraphs that follow the sub-numbered 6.1.1–6.1.3 block exactly (5), so each tag is restored to its paragraph below in original order. The final paragraph of this section has no corresponding tag and is left unnumbered — consistent with this document's own pattern elsewhere of an unnumbered closing sentence after a numbered list, e.g. Section 14's closing paragraph after items (a)–(h).)*

6.1. The following EGs shall register in the WESM:

6.1.1. with Pmax equal to or above the following regional thresholds:
      a) 10 MW for Luzon Grid;

This Circular shall take effect fifteen (15) days after publication in at least two (2) newspapers of general circulation.

Let copy of this Circular be furnished the University of the Philippines Law Center - Office of National Administrative Register (UPLC-ONAR).

Issued this 8th day of February 2019 at the DOE, Energy Center, Rizal Drive, Bonifacio Global City, Taguig City, Metro Manila. *(OCR note: the printed form left the day blank ("Issued this ___ 2019") for handwritten completion; the rasterized page image shows the DOE date stamp "FEB 08 2019" beside the signature, which is used here as the issuance date.)*

## Notes on scan quality

- The signature block (page 8) rendered as garbled characters in the OCR text ("ss ... sot, le' ... poetry ... rt ... FEB08 2019"). Confirmed visually by rendering the page at 300 DPI: signed "ALFONSO G. CUSI, Secretary," with a DOE reply-reference stamp ("DOE-AGC-19000290") and date stamp "FEB 08 2019" beside the signature. The printed "Issued this ___ 2019" blank line was not filled in on the scanned copy; the date stamp is used as the issuance date.
- Every page after page 1 carries a repeated running header/footer ("Department Circular No. DC2019-02-0003 'Providing for the Framework Governing the Operations of Embedded Generators' / Page N of 8") with OCR mangling the circular number differently each time (e.g., "DC2019-08-9003," "DC2019-Q2-0003"). This is page chrome and is omitted throughout above; the circular number is unambiguous from page 1 and the signature-page footer.
- A stray OCR fragment ("g , y") appears on page 2 immediately before the second (public-consultation) date/venue list; this reads as a garbled column header (e.g., "Date / Venue") rather than substantive content, and is dropped as scan noise.
- The first FGD date (page 1, item 6) is rendered "92 May 2018" — not a possible calendar date. Given the following three entries ascend within May then June 2018, the intended value is very likely a day in May, but the document supplies no independent confirmation of which one, so it is marked `[illegible]` rather than guessed.
- Section 6's five numeral tags (6.1–6.5) were recovered from a reading-order artifact — see the inline note at Section 6.
