DO2023-_!/- 0025 be STRENGTHENING THE ENERGY MANAGEMENT TEAM (EMT) AND ENERGY MANAGEMENT SYSTEM (EnMS) WHEREAS, Republic Act (RA) No. 7638 or the Department of Energy (DOE) Act of 1992, as amended, declares the policy of the State to ensure a continuous, adequate, and economic supply of energy with the end in view of ultimately achieving self- reliance in the country’s energy requirements; WHEREAS, RA 11285 or the Energy Efficiency and Conservation (EEC) Act declares the policy of the State to institutionalize EEC as a way of life geared towards the efficient and judicious utilization of energy; WHEREAS, Chapter IV, Section 20 of the EEC Act obligates Designated Establishments (DEs) to integrate an EnMS policy into the business operation based on International Organization for Standardization (ISO) 50001 or any similar framework; WHEREAS, Section 9 of the EEC Act created the Inter-Agency Energy Efficiency and Conservation Committee (IAEECC) to evaluate and approve government energy efficiency projects and to provide strategic direction in the implementation of the Government Energy Management Program (GEMP); WHEREAS, Section 43 of the Implementing Rules and Regulations of the EEC Act (EEC-IRR) states that each government entity shall formulate an energy efficiency and conservation program to include energy conservation measures, target savings, motor vehicle inventory and other strategies consistent with the GEMP; WHEREAS, ISO 500071 is the international framework for the structured practice of managing energy to effect improvements in energy use through the development of an EnMS; WHEREAS, Memorandum Circular No. MC2020-05-0001 titled, “Directing all DEs under Commercial, Industrial, and Transport Sectors to Submit Energy Consumption Reports”, requires all DEs to integrate EnMS in their reportorial requirement submission through the demonstration of EnMS concepts, principles, and practices into business operations; WHEREAS, on 10 January 2023, Department Order (DO) No. DO2023-01-0001, titled “Institutionalizing the EMT to develop an EnMS’”, was issued for purposes of an effective implementation of the EEC Act through the deployment of EnMS in the DOE; and WHEREAS, the EnMS consultant engaged pursuant to Section 3 of DO No. DO2023- 01-0001 recommends strengthening the EMT and EnMS for the successful certification under ISO 50001. Amendments to DO No. DO2023-01-0001. The following provisions are hereby amended as follows: 1.1 Section 1 is hereby amended to read: XXX XXX XXX XXX XXX Section 1. EMT. There shall be an established EMT consisting of the Management Representatives as follows: Chairperson : Director Energy Utilization Management Bureau (EUMB) EEC Focal =: Director Administrative Services Members : Directors of Bureaus, Services and Field Offices The EMT shall be assisted by a Secretariat to be composed of the following: Head : Assistant Director EUMB EEC Focal : Chief General Services Division Members : Representatives from the concerned Bureaus, Services, Field Offices XXX XXX XXX XXX XXX 1.2 Section 2 is hereby amended to read: XXX XXX XXX XXX XXX Section 2. Responsibilities. The EMT under this DO shall perform the following: 2.1. EMT Chairperson shall: a. Plan and direct the Energy Management activities including the determination of audit scope; b. Implement the EnMS; c. Report to the top management the performance of the EnMS; and d. Form a special purpose sub-EMT, serve as auditee for EnMS, and ensure that responsibilities of the EEC Officer, EMT Members, and EMT Secretariat are effectively discharged. === do2023-11-0025-pages-3.ppm === DO No. re Strengthening the EMT and EnMS Page 3 of 3 2.2 EEC Officer and Focal Person shall: a. Own the EnMS; and b. Manage energy use. 2.3. Members shall: a. Ensure the effective planning, implementation, maintenance, continual improvement, monitoring, and evaluation of each Bureau, Service, Division and Unit's EnMS; b. Initiate and coordinate EnMS-related activities to the EMT and Secretariat; and c. Assist the EMT in implementing EnMS. 2.4 EMT Secretariat shall: a. Assist the EMT in ensuring the implementation and sustainability of the EnMS; b. Coordinate the EMT related activities with all Bureaus, Services and Field Offices; c. Collaborate with and assist the various EMT, including the ISO Consultant, to maximize synergistic efforts for the continual improvement of each Bureau, Service and Field Office’s EnMS; and d. Provide feedback/update to the EMT on the status of EnMS implementation of each Bureau, Service and Field Office. XXX XXX XXX XXX XXX Section 2. Separability Clause. If, for any reason, any section or provision of this DO is declared to be unconstitutional or invalid, such part not affected thereby shall remain in full force and effect. Section 3. Repealing Clause. All laws, presidential decrees, executive orders, issuances, rules, and regulations inconsistent with the provisions of this DO are hereby repealed or modified accordingly. Section 4. Effectivity Clause. This DO shall take effect immediately upon signing and shall remain in force unless revoked by the undersigned or competent authority.
