DC2026-03-0010 ji INTERIM AUTHORITY TO INTRODUCE EURO II/2 PETROLEUM PRODUCTS IN THE TRANSPORT AND INDUSTRY SECTOR WHEREAS, Section 5 of Republic Act (R.A.) No. 7638, otherwise known as the “Department of Energy Act of 1992,” as amended by Section 37 of R.A. No. 9136, otherwise known as the “Electric Power Industry Reform Act of 2001,” empowers the Department of Energy (DOE) to formulate, plan, and implement comprehensive programs for the efficient supply and economical use of energy consistent with the approved national economic plan, policies on environmental protection and conservation and maintenance of ecological balance, and provide a mechanism for the integration, rationalization, and coordination of the various energy programs of the Government; WHEREAS, Section 15(f) of R.A. No. 8479, otherwise known as the “Downstream Oil Industry Deregulation Act of 1998,” provides that, concomitant with the policy of ensuring a continuous, adequate and economic supply of energy, the DOE has the power under Section 5 of RA 7638 to establish and administer programs for the exploration, transportation, marketing, distribution, utilization, conservation, stockpiling, and storage of energy resources of all forms, whether conventional or nonconventional; WHEREAS, R.A. No. 8749, otherwise known as the “Philippine Clean Air Act of 1999,” authorizes the DOE to set the specifications for all types of fuel and fuel-related products and to regulate the use of any fuel; WHEREAS, Section 5 of R.A. No. 9367 otherwise known as the “Biofuels Act of 2006,” as amended by Section 37 of R.A. No. 9136, mandates that all liquid fuels for motors and engines sold in the Philippines shall contain locally-sourced biofuels components; WHEREAS, Department Circular (DC) No. 2007-05-0006 (Rules and Regulations Implementing R.A. No. 9367) and Joint Administrative Order No. 2008-01, series of 2008 define as a prohibited act the sale and possession of biofuels and biofuel blends that do not conform to the applicable Philippine National Standards (PNS), and prescribe the corresponding penalties therefor; WHEREAS, Section 1 of DC No. DC2015-06-0004 (Implementing the Corresponding Philippine National Standard Specifications (PNS) for the EURO 4/IV-PH Fuels Complying with the EURO 4/IV Emissions Standard), mandates the implementation of the standard specifications for Euro 4/IV-PH fuels; WHEREAS, DC No. DC2019-02-0002 (/mplementing the Specifications for PNS/DOE QS 008:2018, E-Gasoline Fuel — Specification), sets forth the product specifications and quality standards for gasoline; Energy Center, Rizal Drive cor. 34th Street, Bonifacio Global City, Taguig City, Philippines 1632 Tel. Storage, Handling, and Dispensing Guidelines. The DOI shall implement measures to ensure the distinction between Euro II/2 and Euro IV/4 products being offered to customers. Among others, the DOI participants shall implement the following: a. Refinery, Depot, and Import Terminal. 1. Compatible storage capacity to accommodate separate Euro II/2 and Euro IV/4 fuels; and, 2. Sufficient and compatible transport system to accommodate the delivery of Euro II/2 and Euro IV/4 fuels. b. Dedicated storage tank for Euro II/2 and Euro IV/4 fuels; 2. Dedicated dispensing pump for Euro II/2 and Euro |V/4 fuels; 3. Ensure the conspicuous posting at the dispensing pumps of the required advisory stickers as provided in the Annex A and B; and, 4. Give proper precautions and inform the vehicle owner of the advisory before proceeding with dispensing Euro II/2 and Euro IV/4 fuels to the vehicle. Section 3. Scope and Limitations on the use of Euro II/2 fuels. The use of Euro II/2 fuels is limited to the following: a. All in-use vehicle models from 2015 and earlier, including but not limited to, cars, motorcycles, buses, etc.; b. Traditional jeepneys; c. Industrial use such as, but not limited to, powerplants, generators, etc.; and, d. Marine and shipping industry. Section 4. Notification Requirements. The DO! participants intending to make available Euro II/2 fuels shall accordingly inform the OIMB through a letter-notification of its intent to offer said products with a list of participating liquid fuel retail outlet/s. Section 5. Product Quality Monitoring. The DOE shall conduct random quality sampling and testing in the DOI facilities to ensure compliance with the PNS/DOE QS 015:2021, PNS/DOE QS 016:2021, PNS/DOE QS 008:2018, PNS/DOE QS 019:2023 and interim quality specifications provided in Section 1 hereof. Section 6. Prohibited Acts and Imposition of Penalties. The following acts shall be subject to penalties as set out in the applicable law and regulation: a. Adulteration of petroleum fuel products, including failure to meet the required product specifications under Section 1 hereof; and, b. All other prohibited acts punishable under other laws and regulations. Section 7. Separability Clause. Should any provision of this Circular be subsequently declared invalid or unconstitutional, such parts that are not affected shall remain in full force and effect. Section 8. Repealing Clause. All other rules and regulations or parts thereof which are inconsistent with this Circular are hereby repealed or modified accordingly.
