DC2023-05- 0012 OR THE ELECTRIC VEHICLE (EV) RECOGNITION GUIDELINES WHEREAS, Republic Act (RA) No. 7638 or the “Department of Energy (DOE) Act of 1992" declares as a policy of the State, among others, to ensure a continuous, adequate, and economic supply of energy with the end in view of ultimately achieving self-reliance in the country’s energy requirements through the integrated and intensive exploration, production, management, and development of the country’s indigenous energy sources; WHEREAS, RA No. 11697 or the “Electric Vehicle Industry Development Act” (EVIDA) declares as a policy of the State to ensure the country's energy security and independence by reducing reliance on imported fuel for the transportation sector; and provide an enabling environment for the development of electric vehicles (EVs) including options for micromobility as an attractive and feasible mode of transportation to reduce dependence on fossil fuels: WHEREAS, Section 6(a) of the EVIDA provides for the Comprehensive Roadmap for the Electric Vehicle Industry (CREVI) — a national development plan for the EV industry with an annual work plan to accelerate the development, commercialization, and utilization of EVs in the country, comprising the EVs and charging stations as one component, which includes the development of standards and specifications of EVs and charging stations, among others; WHEREAS, Section 7 of the EVIDA designates the DOE is the primary agency tasked with the promotion of the adoption of EVs and the development of charging stations and related equipment; WHEREAS, pursuant to Rule II of the Implementing Rules and Regulations of the EVIDA (EVIDA-IRR), the DOE issued Department Circular (DC) No. DC2023-05-0012, or the EV Recognition Guidelines, requiring all road transport vehicle manufacturers, assemblers, importers, and rebuilders (MARs) to notify the Energy Utilization Management Bureau (EUMB) of all claimed EVs for recognition; WHEREAS, the number of recognized EV models has increased to around nine hundred ten (910) as of April 2025, thereby making them eligible for incentives provided in the EVIDA and Executive Order No. 62, s. 2024, entitled “Modifying the Nomenclature and Rates of Import Duty on Various Products,” which covers, among others, EVs; WHEREAS, on 03 November 2022, the Philippines acceded to the UN/ECE 1958 Agreement entitled “Agreement Concerning the Adoption of Harmonized Technical United Nations Regulations for Wheeled Vehicles, Equipment and Parts which can be Fitted and/or be used on Wheeled Vehicles and the Conditions for Reciprocal Recognition of Approvals Granted on the Basis of these United Nations Regulations”; Energy Center, Rizal Drive cor. 34th Street, Bonifacio Global City, Taguig City, Philippines 1632 Tel. No. (Trunkline) (632) 8479-2900 Website: http://www.doe.gov.ph: E-mail: infocenter@ doe.gov.ph === dc2025-09-0015-pages-02.ppm === DC on Prescribing Amendments to DC No. DC2023-05-0012 or the EV Recognition Guidelines Page 2 of 9 WHEREAS, there is a need to further streamline the procedures and requirements under the EV Recognition Guidelines to ensure its effective implementation, including its integration with the Philippine Transport Vehicle Fuel Economy Labeling Program (VFELP); and WHEREAS, the draft DC was presented and comments were solicited from stakeholders on 15 and 23 July 2025 in the National Capital Region, Luzon, Visayas, and Mindanao. NOW, THEREFORE, for and in consideration of the foregoing premises and pursuant to its mandate under the EVIDA and EVIDA-IRR, the DOE hereby issues, adopts, and promulgates the following: Section 1. Amendments to the EV Recognition Guidelines. The following provisions are hereby amended: 1.1 Section 3 is hereby amended to read: Section 3. Definition of Terms. In addition to the terms provided under Section 4, Rule | of the EVIDA-IRR, the following terms, as used in this DC, shall apply: 3.1 “Electric Vehicle” (EV) refers to a vehicle with at least one (1) electric drive for vehicle propulsion; 3.2 “Electric Drive’ refers to the combination of an electric traction motor, power electronics, and their associated controls for the conversion of electric energy into mechanical energy, and vice versa; 3.3 “Electric Machine” refers to an energy converter that can operate as an electric motor, an electric generator, or as an electric motor-generator; 3.3.1 “Electric Motor’ refers to an electric machine transforming electrical energy (input) into mechanical energy (output); 3.3.2 “Electric Generator” refers to an electric machine transforming mechanical energy (input) into electric energy (output); and 3.3.3 “Electric Motor-Generator’ refers to an electric machine transforming electric energy (input) into mechanical energy (output), and vice versa. 3.4 “EUMB” refers to the Energy Utilization Management Bureau of the DOE; === dc2025-09-0015-pages-03.ppm === DC on Prescribing Amendments to DC No. DC2023-05-0012 or the EV Recognition Guidelines 3.5 3.6 3.7 3.8 3.9 3.10 3.11 3.12 3.13 3.14 Page 3 of 9 “External Energy Source” refers to an external electric power supply, not part of the vehicle, that supplies electric energy to a vehicle; “Fuel Cell’ refers to an energy converter that transforms chemical energy from a fuel into electrical energy through a chemical reaction with oxygen or another oxidizing agent; “Fuel Storage System” refers to a power source that stores chemical energy in liquid or gaseous form; “Importer” refers to any individual, partnership, corporation, or other entity incorporated, organized, and existing under Philippine laws, engaged in the importation of completely built units of EVs, EV charging stations (EVCS), and related equipment, parts and components, and batteries; “Manufacturer” or “Assembler” refers to any individual, partnership, corporation, or other entity incorporated, organized, and existing under Philippine laws, engaged in the manufacture and assembly of EVs, EVCS, and related equipment, parts and components, and batteries; “Power Source” refers to the energy storage system of the powertrain whose output energy is used directly or indirectly for vehicle propulsion. For the purpose of this DC, a power source shall also be defined as propulsion energy storage system. Categories of power source shall include: (i) a fuel storage system, (ii) a rechargeable energy storage system, or (iii) chemical energy (including fuels); “Rechargeable Energy Storage System” (RESS) refers to a rechargeable system that stores energy for delivery of electric energy for the electric drive. For the purpose of this DC, examples of RESS are battery, capacitor, flywheel: “Recognized EV” refers to an EV, and its conversion kit, that is described, advertised, promoted, or sold by road transport vehicle MARs, and which has been determined under this DC to qualify for the incentives provided in the EVIDA; “Road Vehicle” refers to a vehicle designed to operate on a road; “Traction Battery” refers to ail battery packs that are electrically connected for the supply of electric power to the electric drive and to the conductively connected auxiliary electric system, if any; and === dc2025-09-0015-pages-04.ppm === DC on Prescribing Amendments to DC No. DC2023-05-0012 or the EV Recognition Guidelines 1.2 Page 4 of 9 3.15 “Transport Vehicles” refer to land, air, or water vehicles used to convey cargo or passengers, regardless of size or weight classification. Section 4 is hereby amended to read: Section 4. Recognition of EV. To provide a harmonized adoption of EVs in line with the targets under the Comprehensive Roadmap for the EV Industry (CREVI), EVs shall be classified as follows: 4.1. Battery EVs (BEVs) are those EVs with only a traction battery as power source for vehicle propulsion. For the purpose of this DC, pure electric vehicles (PEV) shall also be defined as BEVs. 4.2 Hybrid EVs (HEVs) are those EVs with both a RESS and a fueled power source for propulsion that has tailpipe emissions: Provided, That an HEV must be able to propel itself from a stationary condition using solely an electric motor. For the purpose of this DC, non-externally chargeable HEVs or non-off-vehicle chargeable HEVs shall be defined as HEVs. 4.3 Light EVs (LEVs) are those EVs used in micromobility that provide aiternative modes of transportation, which include electric scooters, electric bicycles, electric personal transport, and other similar vehicles weighing less than fifty kilograms (50 kg). 4.4 Plug-in Hybrid EVs (PHEVs) are those HEVs with a RESS that can be charged from an external energy source that has tailpipe emissions. For the purpose of this DC, externally chargeable HEVs or off-vehicle-chargeable HEVs shail also be defined as PHEVs. 4.5 Range Extender/d EVs (REEVs) are those HEVs propelled by an electric motor only with a fueled power source that is solely used for charging the RESS of the vehicle to extend the driving range by generating electricity to recharge the RESS. For the purpose of this DC, REEVs shall be understood as either series HEVs or series PHEVs. 4.6 Fuel Cell EVs (FCEVs) are those EVs with no tailpipe emissions that use a fuel cell to generate electricity to power their electric motor for propulsion. In recognition of advances and innovation of technologies, EVs may be further classified by the DOE upon notice by vehicle MARs: Provided, That the vehicle has at least one (1) electric drive used for propulsion. The EV Recognition Assessment Form under this DC shall be adopted (Annex A). === dc2025-09-0015-pages-05.ppm === DC on Prescribing Amendments to DC No. DC2023-05-0012 or the EV Recognition Guidelines Page 5 of 9 1.3 Section 6 is hereby amended to read: Section 6. EV Recognition Documentary Requirements. All road transport vehicle MARs shall notify the EUMB of all claimed EVs and shall submit the following documentary requirements: 6.1 6.2 6.3 6.4 6.5 Notice to DOE through the EUMB (Annex B); Duly accomplished Specification Form (Annex C); UNR 136 Test Report, or its equivalent, as applicable, conforming to the requirements and procedures under Section 9 of this DC; UNR 101 Test Report, or its equivalent, as applicable, conforming to the requirements and procedures under Section 9 of this DC; and Official receipt of the EV Recognition Application Fee. 1.4 Section 7 is hereby amended to read: Section 7. Processing of EV Recognition Application. The procedure for EV recognition, as indicated in Annex D of this DC, shall be as follows: 7.1 7.2 7.3 All vehicle MARs shall apply to the EUMB for every EV claimed for sale in the market. All applications shall be submitted through the Philippine Transport Vehicle Fuel Economy Labeling Program (VFELP) System. Within twenty (20) working days, the EUMB shall process the application. Upon determination of the completeness of the documents, the application shall be reviewed, its authenticity validated, and, if found compliant, the recognized EV shall be included in the Recognized EV List: Provided, That incomplete submissions or applications not conforming to Section 6 of this DC shall be returned. Failure to complete and resubmit the returned applications within seven (7) working days shall be treated as a new application: Provided, further, That any verified falsification of documents shall be a ground for revocation and/or blocklisting of the concerned EV model for EV recognition. Recognized EVs notified by MARs as discontinued or no longer offered for sale in the Philippines shall be classified as “not marketed” and removed from the Recognized EV List. Vehicle MARs shall submit a formal notification and request for deletion of the EV model to the EUMB (Annex E). === dc2025-09-0015-pages-06.ppm === DC on Prescribing Amendments to DC No. DC2023-05-0012 or the EV Recognition Guidelines 7.4 7.5 7.6 7.7 Page 6 of 9 Applicants or vehicle MARs shall submit the EV Charger Monitoring Form (Annex F) every fifteenth (15") day of the month following the end of each quarter. For duplicate submissions, the DOE shall only process the first submission filed for a particular EV type and its variants. Any subsequent application with the same specifications filed within six (6) months from the first submission shall not be accepted for processing: Provided, That the applicant has complied with the Company Registration requirements under the VFELP. For revisions regarding data and/or information from submissions, the MARs shall file a request through the VFELP System. These shall be acted upon by the DOE within twenty (20) working days: Provided, That revisions of data and/or information shall not include the following: . EV Classification; . Vehicle Type; . Type of Transmission; Body Type; . Electric Motor Rating; Traction Battery Energy; and . Charger Connector. a->onan00m Requests for revisions of the abovementioned data and/or information shall be accepted as a new EV recognition application. For EVs intended for promotion, pre-launch activities, and non-marketing, the applicant shall submit a Notice to the EUMB (Annex B) requesting EV recognition with the following minimum specifications: Vehicle Classification; EV Classification; Vehicle Make; Name and Address of Manufacturer; Vehicle Type; Year Model; Vehicle Size (m); Gross Vehicle Weight (kg); Maximum Engine Power (kW), as applicable; Maximum Electric Power (kW); and Battery Capacity. zoo sa *P AO TD Such application shall be issued a Provisional Certificate of EV Recognition valid for six (6) months for EVs intended for promotion and pre-launch activities, and a Certificate of EV Recognition (Non-Marketing) for EVs for used for other === dc2025-09-0015-pages-07.ppm === DC on Prescribing Amendments to DC No. DC2023-05-0012 or the EV Recognition Guidelines 1.5 1.6 Page 7 of 9 non-marketing purposes. The applicant shall pay the applicable fees under Section 8 of this DC. A new Section 8 is hereby added to read: Section 8. Application Fees for EV Recognition. Application fees under this DC shall apply per vehicle model and shall be categorized according to the vehicle body type, in accordance with the Table of Fees (Annex G). All application fees are non-refundable. A new Section 9 is hereby added to read: Section 9. Inspection and Verification. For applications with inconsistent documents or without a valid UNR 136 or UNR 101 Test Report, or an equivalent test report, as required and validated under Section 6 of this DC, the DOE shall conduct the following inspection and verification of the vehicle: 9.1. The applicant shall physically present the vehicle at the DOE Central Office at the Energy Center, Rizal Driver corner 34" Street, Bonifacio Global City, Taguig City on the date and time indicated in the Notice of Inspection and Verification issued by the DOE through the EUMB, subject to the availability of technical inspector/s of the Electric Vehicle Industry Management Division (EVIMD). 9.2 Failure of the applicant to physically present the vehicle at the date and time indicated in the Notice of Inspection and Verification shall result in the denial of the application. 9.3 If the vehicle cannot be physically presented on the date and time indicated in the Notice of Inspection and Verification for whatever reason, the applicant shall officially inform the EUMB by filing a Request for Change Date/Time/Place of Inspection and Verification. When the request is approved by the EUMB, the applicant shall arrange all necessary logistical requirements for the rescheduled inspection and verification. 9.4 Within seven (7) working days from the completion of the inspection and verification, the EUMB shall issue a Certificate of Inspection and Verification to the applicant, which shall be submitted as the document under Section 6.3 of this DC to proceed with the application. 9.5 After public consultation, the EUMB shall issue Implementing Guidelines for the administration of this DC, including the procedure for inspection and verification. === dc2025-09-0015-pages-08.ppm === DC on Prescribing Amendments to DC No. DC2023-05-0012 or the EV Recognition Guidelines Page 8 of 9 1.7 Section 8 is hereby amended to read: Section 10. Recognized EV List. Pursuant to Section 11(m) of the EVIDA-IRR and this DC, the DOE, through the EUMB, shall maintain a list of recognized EVs for easy access and reference. The list shall serve as the basis for granting incentives provided in the EVIDA and the EVIDA IRR. The DOE shall make the list available to the public and regularly updated. 1.8 Sections 9 to 13 of DC No. DC2023-05-0012 are hereby renumbered as Sections 11 to 15, respectively. 1.9 All Annexes of DC No. DC2023-05-0012 are hereby amended as Annexes A to G. Section 2. Transitory Clause. All recognized EVs prior to the effectivity of this DC shall retain their recognition: Provided That, such previously recognized EVs shall register with the VFELP System within ninety (90) calendar days from the effectivity of this DC. The EV recognition application fees for previously recognized EVs shall be waived. Section 3. Repealing Clause. All circulars, orders, or issuances inconsistent with the provisions of this DC are hereby amended, modified, or superseded accordingly. Section 4. Separability Clause. If for any reason, any section or provision of this DC is declared unconstitutional or invalid, such parts not affected shall remain in full force and effect. Section 5. Effectivity. This DC shall take effect fifteen (15) days following its publication in the Official Gazette or in a newspaper of general circulation.
