=== dc2025-08-0012-pages-01.ppm === Republic of the Philippines DEPARTMENT OF ENERGY (Kagawaran ng Enerhiya) BAGONG PILIPINAS DEPARTMENT CIRCULAR NO. _ OC Zo<5- 5&- ooly PRESCRIBING THE POLICY AND GUIDELINES FOR INTEGRATING THE CHARGING INFRASTRUCTURE DEVELOPMENT PLAN TO THE DISTRIBUTION DEVELOPMENT PLAN PURSUANT TO THE ELECTRIC VEHICLE INDUSTRY DEVELOPMENT ACT AND THE COMPREHENSIVE ROADMAP FOR THE ELECTRIC VEHICLE INDUSTRY WHEREAS, Republic Act No. (RA) 7638 or the “Department of Energy (DOE) Act of 1992” declares as a policy of the State, among others, to ensure a continuous, adequate, and economic supply of energy with the end in view of ultimately achieving self-reliance in the country’s energy requirements through the integrated and intensive exploration, production, management, and development of the country’s indigenous energy sources; WHEREAS, Sections 5 (e) and (h) of RA 7638 authorize the DOE to regulate private sector activities, as provided under existing laws, providing therein an environment conducive to free and active private sector participation and investment in all energy activities, as well as to formulate and implement a program for the accelerated development of non-conventional energy systems and the promotion and commercialization on its applications; WHEREAS, Section 2 (b) of RA 9136 or the “Electric Power Industry Reform Act of 2001 (EPIRA),” declares the policy of the State to ensure the quality, reliability, security and affordability of the supply of electric power; WHEREAS, Section 23 of the EPIRA requires Distribution Utilities (DUs) to prepare and submit to the DOE their annual Distribution Development Plan (DDP) and, in the case of Electric Cooperatives (ECs), to submit such plans to the DOE through the National Electrification Administration (NEA); WHEREAS, RA 11697 or the “Electric Vehicle Industry Development Act (EVIDA)” declares that it is the policy of the Government to provide an enabling environment for the development of electric vehicles (EVs), including options for micromobility as an attractive and feasible mode of transportation to reduce dependence on fossil fuels; WHEREAS, Section 7 (g) of the EVIDA and Rule V, Section 23 (g) of its Implementing Rules and Regulations (EVIDA-IRR) require DUs to submit their respective charging infrastructure development plans as part of their DDPs not later than the 30" of August of every year; WHEREAS, Section 23 (a) of the EVIDA and Rule VI, Section 26 (a) of the EVIDA- IRR mandate DUs to provide the necessary power requirement for the establishment and operation of charging stations consistent with their respective DDPs; WHEREAS, Rule V, Section 23 of the EVIDA-IRR mandates the DOE, in consultation with the EVIDA - Technical Working Group, to issue guidelines for the effective implementation of the abovementioned provisions of the IRR, among others; Energy Center, Rizal Drive cor. 34th Street, Bonifacio Global City, Taguig City, Philippines 1632 Tel. DA-IRR enumerate the prohibited acts and penalties for violations of the EVIDA; WHEREAS, DOE Department Circular (DC) No. DC2021-03-0003, entitled “Prescribing the Policy and Guidelines for the Formulation of the Distribution Utilities Distribution Development Plan Integrating the Relevant Laws, Policy Issuances, Rules and Regulations,” directs DUs and other mandated entities to submit their DDPs with utmost diligence and accuracy, with the end goal of providing secure, reliable and efficient power service delivery to their customers and end-users at all times; WHEREAS, DOE DC No. DC2023-05-0011 or the EVCS Providers Accreditation and EVCS Registration Guidelines provides for the accreditation of EV Charging Station (EVCS) Providers and the registration of EVCS to the DOE; and WHEREAS, the draft DC was presented and comments were solicited from stakeholders on 25 June and 23 July 2025 in the National Capital Region, Luzon, Visayas, and Mindanao. NOW, THEREFORE, in consideration of all the foregoing, the DOE hereby issues, adopts, and promulgates the following: Section 1. Title. This DC shall be known as the “Charging Infrastructure Development Plan (CIDP) Guidelines.” Section 2. Scope. This DC shall establish the policy and guidelines for the integration of the CIDP of EVCS in the DDP which shall apply to all DUs and other entities mandated to distribute electric power. Section 3. Guiding Principles. The following shall be taken into consideration in the formulation of the CIDP in addition to those enumerated in Section 3 of DC No. DC2021-03-0003: 3.1. Support the requirements and targets under the Comprehensive Roadmap for the EV Industry (CREVI); 32. Provide for investments of EVCS Providers in their installation and operation of EVCS, including the utilization of renewable energy (through on-site generation or attribution mechanisms); 3.3. Support the electrification of Local Public Transport Route Plans (LPTRP); and 3.4. Encourage public-private partnerships (PPPs) to foster investment in EVCS development. Section 4. Procedures for the Integration of the CIDP in the Preparation of DDP. All DUs and other entities mandated to distribute electric power shall adhere to the following procedures in preparing their respective DDPs: 4.1. When filling out the “Customer and Consumption Data” sheet of the DOE- Electric Power Industry Management Bureau (EPIMB) DDP Form 2021-01- === dc2025-08-0012-pages-03.ppm === DC on Policy and Guidelines for Integrating the CIDP to the DDP pursuant to EVIDA and the CREVI 4.2. Page 3 of 13 001, the power supply requirements of EVCS must be incorporated into the demand and energy forecast under the “All Others” customer classification. A write-up on the CIDP shall be included in the Narrative Summary of the DDP. A sample excerpt of the write-up is attached as Annex A of this DC. The energy requirements of EVCS shall be based on the technical specifications provided in the Monitoring and Operation Report Form (Annex G of DC No. DC2023-05-0011), as submitted to the DU by EVCS Providers. Ensure the timely, effective, and accurate identification, scheduling, and implementation of necessary expansion, upgrading, and rehabilitation of the distribution system to accommodate the installation and operation of EVCS as part of their Capital Expenditure (CapEx) Projects. Section 5. Provision of Electric Service for the Operation of EVCS. All DUs, the Transmission Network Service Provider (TNSP), and other entities mandated to provide electric power shall consider the following to ensure the provision of the necessary power requirements for the establishment and operation of EVCS: 5:1. 52. 5.3. For electric service applications submitted by the EVCS Providers, the TNSP and the DU shall act upon the same within twenty (20) working days, which may be extended to another twenty (20) working days, from receipt of complete requirements, in accordance with Rule VI, Section 26 (a) of the EVIDA-IRR. The concerned DU shall not unreasonably delay or otherwise obstruct the processing of such applications. The projected load demand of the EVCS shall be analyzed to determine whether the existing transmission or distribution system can accommodate the additional load. In case a system upgrade is deemed necessary, the responsible entity— either the TNSP or DU, as applicable—shall require the EVCS Provider to submit electrical plans duly signed and sealed by a licensed Professional Electrical Engineer. The responsible entity shall also provide a detailed breakdown of the estimated costs, including, but not limited to, labor, materials, and other related expenses for the system upgrade. The TNSP or DU shall complete the load analysis and provide the corresponding cost estimates and technical details within twenty (20) working days, which may be extended to another twenty (20) working days, from receipt of the complete application and supporting documents, to ensure transparency and informed decision-making. If the necessary system upgrade is not included in the approved CapEx plan, the DU or TNSP shall undertake the required upgrades at the expense of EVCS Providers and ensure the timely connectivity and operation of EVCS. === dc2025-08-0012-pages-04.ppm === DC on Policy and Guidelines for Integrating the CIDP to the DDP pursuant to EVIDA and the CREVI Page 4 of 13 The DU or TNSP shall assume full operational responsibility and integrate the facilities into its respective system within twenty (20) working days, which may be extended to another twenty (20) working days, from the date of satisfactory completion of all testing procedures and submission of required documents. Cost recovery shall be allowed through duly approved mechanisms of the Energy Regulatory Commission (ERC), to the extent that the upgrades result in incidental benefits to the TNSP or DU, such as improved electric service reliability or increased capacity for existing customers. The process flow chart and timelines for the processing of electric service applications are summarized and may be referred to in Annex B of this DC. Section 6. EVCS Power Source. Section 7. Process Streamlining. The requirements and timelines under this DC shall strictly conform with Section 9 of the EVIDA-IRR. The DOE, through the Energy Utilization Management Bureau (EUMB), shall issue implementing guidelines for the effective administration of this DC, including provisions for EVCS Providers sourcing power through a combination of different supply modes, as well as the corresponding requirements and implementation timelines: Provided, That the implementing guidelines shall only be issued after public consultation. Section 8. Information, Education, and Communication Activities. Pursuant to Section 11 (e) of the EVIDA-IRR, the DOE shall develop and undertake a national awareness and advocacy program and pursue partnerships with relevant stakeholders for the appreciation of this DC. Section 9. Prohibited Acts. Pursuant to Section 28 of the EVIDA, any person both natural or juridical—including EVCS Providers and their responsible officers and personnel, as well as DUs and other mandated entities—shall be subject to the imposition of penalties for violations of the following provisions: a. Non-compliance with Section 20 (Use of Charging Stations) of the EVIDA; b. Violation of Section 21(Permits) of the EVIDA; é. Violation of Section 22 (Duties and Responsibilities of Owners or Operators of Charging Stations) of the EVIDA; and d. Violation of Section 23 (Duties and Responsibilities of Distribution Utilities) of the EVIDA. Section 10. Penalties. Upon determination that any person or entity has committed any of the prohibited acts in Section 9 of this DC, a fine ranging from a minimum of Fifty Thousand Pesos (P50,000.00) to a maximum of Five Hundred Thousand Pesos (P500,000.00) shall be imposed, as specified in Annex C. === dc2025-08-0012-pages-07.ppm === DC on Policy and Guidelines for Integrating the CIDP to the DDP pursuant to EVIDA and the CREVI Page 7 of 13 Penalties may include the suspension or revocation of the EVCS Provider Accreditation or blocklisting under this DC. In the case of entities operating under a legislative franchise, the DOE may recommend the suspension or revocation of such franchise to the appropriate authority, such as Congress, in accordance with existing laws and procedures. The imposition of fines is without prejudice to the penalties provided under existing laws, rules, and regulations prescribed by other concerned agencies. Section 11. Amendment Clause. The DOE may revise, supplement, and issue related guidelines, circulars, and other subsidiary issuances as it deems necessary for the effective implementation of the various provisions of this DC. Section 12. Repealing Clause. All circulars, orders, or issuances inconsistent with the provisions of this DC are hereby amended, modified, or superseded accordingly. Section 13. Separability Clause. If for any reason, any section or provision of this DC is declared unconstitutional or invalid, such parts not affected shall remain in full force and effect. Section 14. Effectivity. This DC shall take effect fifteen (15) days following its publication in the Official Gazette or in a newspaper of general circulation.
