SR 2020-06 TITLED “RULES AND REGULATIONS ON THE MANDATORY USE OF 0.50% M/M SULPHUR LIMIT ON FUEL OIL FOR ALL PHILIPPINE REGISTERED SHIPS IN COMPLIANCE WITH ANNEX VI OF MARPOL 73/78, AS AMENDED” WHEREAS, Section 5 of Republic Act (RA) No. 7638, otherwise known as the “Department of Energy Act of 1992,” as amended by Section 37 of RA 9136, otherwise known as the “Electric Power Industry Reform Act of 2001,” empowers the Department of Energy (DOE) to formulate policies for the planning and implementation of a comprehensive program for the efficient supply and economical use of energy consistent with the approved national economic plan, and with the policies on environmental protection and conservation and maintenance of ecological balance, and provide a mechanism for the integration, rationalization, and coordination of the various energy programs of the Government; WHEREAS, Section 5 of RA 7638, as amended by Section 37 of RA 9136, further empowers the DOE to formulate and implement programs for the accelerated development of non-conventional energy systems and the promotion and commercialization of their applications; WHEREAS, Section 14 of RA 8479, otherwise known as the “Downstream Oil Industry Deregulation Act of 1998,” empowers (1) the DOE to monitor the quality of petroleum products and stop the operations of businesses engaged in the sale of petroleum products which do not comply with national standards/protocols of quality, and (2) the Bureau of Product Standards (BPS) of the Department of Trade and Industry, together with the Department of Environment and Natural Resources, the DOE, the Department of Science and Technology, representatives of the fuel and automotive industries and the consumers, to set the specifications for all types of fuel and fuel-related products to improve fuel composition for increased efficiency and reduced emissions; WHEREAS, Batas Pambansa (BP) Blg. 33, as amended by Presidential Decree (PD) No. 1865, titled “An Act Defining and Penalizing Certain Prohibited Acts Inimical to the Public Interest and National Security Involving Petroleum and/or Petroleum Products, Prescribing Penalties Therefore and For Other Purposes,” prohibits, and provides for penalties for the adulteration of petroleum products; WHEREAS, Section V - General Provision of MARINA Circular No. SR 2020-06 provides that, by 1 January 20285, all fuel oil used on board ships for propulsion or operation shall have a maximum sulphur content of 0.50% per mass by mass including all gas, petrol, distillates, residual and blended fuels; === dc2025-02-0003-pages-02.ppm === DC on Guidelines for Compliance of Marine Fuel Bunker Traders in Relation to Maritime Industry Authority (MARINA) MC No. SR 2020-06 Titled “Rules and Regulations on the Mandatory Use of 0.50% M/M Sulphur Limit on Fuel Oil for All Philippine Registered Ships in Compliance with Annex VI of MARPOL 73/78, As Amended” Page 2 of 5 WHEREAS, there is a global thrust towards the harmonization of fuel quality standard specifications and vehicle technology and emission standards, with due regard to the environment, vehicle performance, health and safety and for easier global/ international trade; WHEREAS, BPS promulgated PNS ISO 8217:2024 (ISO published 2024): Products from petroleum, synthetic and renewable sources — Fuels (class F) — Specifications of marine fuels, as the current separate standard specifications for marine fuels; NOW, THEREFORE, in consideration of the foregoing premises, the DOE hereby issues, adopts and promulgates the following: Section 1. Scope and Application. This Department Circular (DC) shall apply to all Downstream Oil Industry (DOI) participants engaged in the bunker trading / sale of marine fuel, to comply with the following: 1.1 Residual Marine Fuel PNS ISO 8217:2024 Table 2 — Residual marine fuels with sulfur content below or at 0.50% by mass shall be the reference specification for residual marine fuels allowed for domestic use. 1.2 Marine Distillate Fuel In compliance with RA 9367, otherwise known as the “Biofuels Act of 2006,” specifications of marine distillate fuels shall refer to Philippine National Standard (PNS) for Automotive Diesel Oil (ADO) and PNS for Industrial Diesel Oil (IDO) at the time of application. Section 2. Compliance of Marine Fuel Bunker Trader with the DOE DC No. DC2021-09-0029 2.1. Notices All Marine Fuel Bunker Traders shall comply with all applicable notice and other requirements under DC No. DC2021-09-0029, otherwise known as the “Guidelines on Notices and Reportorial Requirements Pursuant to the Downstream Oil Industry Deregulation Act.” 2.2. Reportorial Requirements All Marine Fuel Bunker Traders shall comply with all applicable reportorial requirements under DC No. DC2021-09-0029, with the following amended reportorial templates: 2.2.1.Monthly Report on Finished Petroleum Product Supply and Demand Summary — (Annex MR-A SUMM-FPP); === dc2025-02-0003-pages-03.ppm === DC on Guidelines for Compliance of Marine Fuel Bunker Traders in Relation to Maritime Industry Authority (MARINA) MC No. SR 2020-06 Titled “Rules and Regulations on the Mandatory Use of 0.50% M/M Sulphur Limit on Fuel Oil for All Philippine Registered Ships in Compliance with Annex VI of MARPOL 73/78, As Amended” Page 3 of 5 2.2.2.Monthly Report on Crude and Finished Petroleum Products Ending Inventory (Annex MR-B); 2.2.3. Monthly Report on Finished Petroleum Products Imports (Annex MR-C); 2.2.4.Monthly Report on Domestic/Local Purchase of Finished Petroleum Products from Importer, Refiner (Annex MR-E); and 2.2.5. Monthly Report on Total Domestic/Local Sales by Region, Trade, Sub-sector, Product and Customer (Annex MR-J). Section 3. Compliance of Marine Fuel Bunker Trader with Fuel Quality Standards. All marine fuels sold in the country shall comply with PNS ISO 8217:2024 (ISO published 2024): Products from petroleum, synthetic and renewable sources — Fuels (class F) — Specifications of marine fuels, and/or PNS for ADO and IDO at the time of application. Section 4. Compliance of Marine Fuel Bunker Trader with DOE Product Quality Testing Requirements The DOE shall conduct random quality sampling and testing of marine fuel in the DOI facilities to ensure compliance with PNS. Section 5. Responsibilities of Marine Fuel Bunker Traders 5.1. Comply with the DOE’s notice and reportorial requirements 5.2. Comply with the issuance of a Bunker Delivery Note (BDN) for every sale of marine fuel to ship owners and/or operators. 5.2.1. A properly accomplished BDN form shall be issued with a copy of the Certificate of Analysis (COA) attached thereto. The template BDN is provided in Annex A hereof. 5.2.2. The sulphur content of the fuel oil delivered shall be documented by its supplier using BDN which shall contain information on fuel oil delivery. 5.2.3. A certified true copy of the BDN shall be submitted to the DOE as an attachment to reportorial requirements. Electronic copies of the BDN may also be submitted to the DOE. 5.3. Comply with the required marine fuel sample, i.e. MARPOL delivered sample for every sale of marine fuel to ship owners and/or operators. === dc2025-02-0003-pages-04.ppm === DC on Guidelines for Compliance of Marine Fuel Bunker Traders in Relation to Maritime Industry Authority (MARINA) MC No. SR 2020-06 Titled “Rules and Regulations on the Mandatory Use of 0.50% M/M Sulphur Limit on Fuel Oil for All Philippine Registered Ships in Compliance with Annex VI of MARPOL 73/78, As Amended” Page 4 of 5 Section 6. Transitory Provision. All importation of marine fuels for domestic shipping are subject to the notification requirements under DC No. DC 2021-09-0029 and shall include the submission of Certificates of Quality (COQ) issued at the source. The DOE shall issue an advisory to fully implement compliance with PNS ISO 8217:2024. For this purpose, it shall assess industry conditions through its quarterly review of the COAs submitted every importation notice. Until the issuance of such advisory, marine fuel importations not fully compliant with PNS ISO 8217:2024 shall be allowed, provided that, they are accompanied by a certification from the supplier/importer on the non-availability of compliant fuels at the time of acquisition of the fuel. However, in no case shall the importation of non-compliant marine fuels be exempted from the mandatory 0.50% maximum sulfur content required for domestic shipping. A vessel owner or operator may refuse to accept non-compliant marine fuels if such fuels may result in adverse operations of their vessels upon the vessel owner or operator's assessment. The vessel owner or operator may find other alternative marine fuel suppliers. All registered marine fuel bunker traders shall be given a transition period for the use and submission of the notices and reports: a. The use of new formats for notices and monthly reports shall be implemented in the second month following the month when this DC takes effect; and b. The use of the new formats for the quarterly reports shall be implemented in the next quarter following the quarter when this DC takes effect. Section 7. Prohibited Acts and Imposition of Penalties. The following acts shall be subject to penalties as set out in the applicable law and regulation: 7.1. adulteration of petroleum fuel products, including failure to meet the required product specifications; and 7.2. all other prohibited acts punishable under other laws and regulations. Section 8. Separability Clause.
