DC Zo2zYg- AN Na PRESCRIBING AMENDMENTS TO DEPARTMENT CIRCULAR NO. DC2020-06-0016 OR THE MINIMUM ENERGY PERFORMANCE FOR PRODUCTS (MEPP) GUIDELINES WHEREAS, Section 2 of Republic Act (RA) No. 7638, as amended, otherwise known as the “Department of Energy Act of 1992,” states that it is the policy of the State to ensure a continuous, adequate, reliable, and economic supply of energy through, among others, judicious conservation, renewal, and efficient utilization of energy, to keep pace with the country’s growth and economic development; WHEREAS, RA 11285, otherwise known as the “Energy Efficiency and Conservation Act” (the “EEC Act’), declares the policy direction of the government in terms of efficiency, conservation, sufficiency, and sustainability in the country; WHEREAS, Section 5 of the EEC Act provides that the DOE shall be the lead agency in the implementation of the EEC Act responsible for the planning, formulation, development, implementation, enforcement, and monitoring of energy management policies and other related EEC plans and programs; WHEREAS, pursuant to Sections 14, 15, and 36 of the EEC Act, the DOE issued Department Circular (DC) Nos. DC2020-06-0015 or the Philippine Energy Labelling Program (PELP) Guidelines, and DC2020-06-0016 or the Minimum Energy Performance for Products (MEPP Guidelines), mandating the compliance of relevant stakeholders involved in the manufacturing, sale, and use of the products covered; WHEREAS, there is a need to redefine the functions of specific DOE units under Section 3 of the MEPP Guidelines for a more efficient and streamlined implementation of the EEC Act; WHEREAS, Section 4 of the MEPP Guidelines provides an initial list of covered Energy Consuming Products (ECPs) under MEPP which may be expanded upon the recommendation of the Energy Utilization Management Bureau (EUMB) to the DOE Secretary; WHEREAS, Section 8 of the MEPP Guidelines provides for the periodic adjustment of the MEPP and review of the MEPP standards and MEPP-covered ECPs listed in Annex A (Table of MEPP), as indicated in Section 9 of the MEPP Guidelines, every three (3) years; : WHEREAS, pursuant to Section 10 of the PELP Guidelines, as amended by DC2022- 11-0035, the Technical Working Group reviewed the MEPP and MEPP-covered ECPs and recommended the expansion and adjustment of Annex A (Table of MEPP) in the eee Energy Center, Rizal Drive cor. 34th Street, Bonifacio Global City, Taguig City, Philippines 1632 Tel. No. (Trunkline) (632) 8479-2900 Website: http://www.doe.gov.ph; Email: infocenter@doe.gov.ph === dc2024-05-0016-pages-2.ppm === DC re: Prescribing Amendments to DC No. DC2020-06-0016 or the MEPP Guidelines Page 2 of 4 MEPP Guidelines and that the same shall be endorsed by the EUMB for approval of the DOE Secretary; WHEREAS, the conservation and efficient utilization of energy are among the major strategies of the Government to realize energy self-sufficiency and reduce environmental impacts of energy generation and utilization as instituted in the Philippine Energy Plan (PEP) and DC2023-05-0018 or the National Energy Efficiency and Conservation Program (NEECP); and, WHEREAS, the DOE conducted public consultations on 29 November 2023 and 08 February 2024 attended by various stakeholders to present the draft DC and to consolidate inputs from stakeholders in Luzon, Visayas and Mindanao. NOW, THEREFORE, for and in consideration of the foregoing premises and pursuant to its mandate under the EEC Act and EEC-IRR, the DOE hereby issues, adopts, and promulgates the following: Section 1. Amendments to the MEPP Guidelines. The following provisions are hereby amended: 4.1. Sections 3a, 3g, and 3h are hereby amended to read: a. AFETD refers to the Alternative Fuels and Energy Technology Division which shall be responsible for the formulation, development and updating fuel efficiency testing guidelines and the Minimum Energy Performance for Transport Vehicles (MEPV) and other transport-related policies in support of the NEECP. EPMPD refers to the Energy Efficiency and Conservation Program Management and Technology Promotion Division, which shall be responsible for the promotion and the Information and Education (IEC) campaign activities related to the MEPP. EPRED refers to the Energy Efficiency and Conservation Performance Regulation and Enforcement Division, which shall be responsible for the formulation, development, and updating of the MEPP and guidelines on on-site inspections, conduct of enforcement, monitoring, and verification activities in compliance with the MEPP. Section 4 is hereby amended to read: Section 4. Covered Energy Consuming Products. Under this Department Circular, the MEPP shall cover ECPs provided under Annex A (Table of MEPP). === dc2024-05-0016-pages-3.ppm === DC re: Prescribing Amendments to DC No. DC2020-06-0016 or the MEPP Guidelines Page 3 of 4 1.3. Section 8 is hereby amended to read: Section 8. Periodic Adjustment of MEPP. The MEPP shail be reviewed by the members of the Technical Working Groups (TWG) of the PELP every three (3) years, or sooner when warranted, pursuant to Section 10 of the PELP Guidelines. The output of the TWG on the MEPP shall be for approval of the EUMB: Provided, That any adjustments to Annex A (Table of MEPP) shall be endorsed by EUMB for approval of the DOE Secretary. Adjustments to the MEPP shall always be directed towards an increase in energy efficiency or improvement in energy performance. 1.4 Section 9 is hereby amended io read: Section 9. Compliance Requirements. To ensure effective implementation, MEPP-covered ECPs must comply with the prescribed MEPP standards in Annex A (Table of MEPP): Provided That, imported ECPs shall comply with the MEPP standards of the country of origin whenever higher or more energy-efficient than what is prescribed under this Department Circular. 1.5 Section 11 is hereby amended to read: Section 11. Penalties. Upon the determination that any person or entity has committed any of the Prohibited Acts outlined in Section 7 of this Department Circular, the DOE may issue an order for the imposition of the administrative fines and penalties as specified in Annex B (Schedule of Penalties and Fines). The imposition of administrative fines and penalties is without prejudice to the institution of criminal liabilities for violations under the EEC Act, EEC-IRR, and this Department Circular. Section 2. Repealing Clause. The provisions of other circulars, orders, issuances, rules, or regulations, which are inconsistent with the provisions of this DC are hereby repealed, amended, modified, or superseded accordingly. Section 3. Separability Clause. If any section or provision of this DC is declared unconstitutional or invalid, such parts not affected shall remain in full force and effect. Section 4. Effectivity. This DC shall take effect fifteen (15) days following its publication in at least two (2) newspapers of general circulation.
