No. (Trunkline) (632) 8479-2900 Website: www.doe.gov.ph: E-mail: infocenter@doe.gov.ph === dc2024-05-0014-pages-02.ppm === DC on Guidelines on Biofuel Blend Implementation Page 2 of 6 WHEREAS, on 05 February 2009, the DOE issued Department Circular (DC) No. DC2009-02-0002 mandating the implementation of two percent (2%) biodiesel blend by volume into all diesel fuel sold and distributed by each and every oil company in the country; WHEREAS, on 06 February 2012, the DOE issued DC No. DC2011-02-0001 mandating the implementation of ten percent (10%) bioethanol blend by volume into all gasoline fuel sold and distributed by each and every oil company in the country; WHEREAS, on 27 December 2021, the BPS promulgated the PNS/DOE QS 01 5:2021 and PNS/DOE QS 016:2021 as the current separate standard specifications for ADOB3 and IDOB3, respectively; WHEREAS, on 31 October 2023, the BPS promulgated the PNS/DOE QS 019:2023 as the current standard specifications for gasoline containing twenty percent (20%) bioethanol blend (E20); WHEREAS, there is a global thrust towards the harmonization of fuel quality standards and specifications, and vehicle technology and emission standards in consideration of the environment, vehicle performance, health and safety and ease in international trade; WHEREAS, following the drastic increase in the cost of fuel over the past years as a consequence of the Ukraine-Russia conflict, production cuts by the Organization of Petroleum Exporting Countries (OPEC) Plus, and global inflation, the NBB has determined that an increase in the bioethanol blend will reduce the pump price of diesel and gasoline fuel and help alleviate the burden of rising prices on consumers; WHEREAS, on 28 November 2023, the NBB, in its Resolution No. 2023-04, Series of 2023, approved the recommendation to the DOE for the mandatory biodiesel blend into all diesel fuel sold and distributed by each oil company in the country at three percent (3%) in 2024, four percent (4%) in 2025 and five percent (5%) in 2026; WHEREAS, on 28 November 2023, the NBB, in its Resolution No. 2023-03, Series of 2023, likewise approved the recommendation to the DOE for the voluntary implementation by any oil company of the twenty percent (20%) bioethanol blend as an additional fuel option to consumers, WHEREAS, the DOE conducted consultations with stakeholders, specifically the biofuel producers and the downstream oil industry, on the implementing guidelines for the new blend requirements; NOW, THEREFORE, in consideration of the foregoing, the DOE hereby issues, adopts, and promulgates the following: Section 1. Scope and Application. Mandatory Implementation of Higher Biodiesel Blend. All diesel fuel distributed and sold by all DOI participants in the country shall contain biodiesel blend at three percent (3%) effective 01 October 2024, four percent (4%) effective 01 October 2025, and five percent (5%) effective 01 October 2026. Section 3. Voluntary Implementation of the Twenty Percent (20%) Bioethanol Blend. The DOI participants may offer consumers gasoline fuel containing twenty percent (20%) bioethanol blend on a voluntary basis. Section 4. Compliance with Product Quality Standard. The DOI participants shall strictly comply with the applicable DOE DCs with respect to the Philippine National Standards (PNS) for diesel and gasoline with biofuel blend. Section 5. Compliance of DOI Participants with the Accreditation, Notification and Reportorial Requirements Pursuant to the Biofuels Act. 5.1 Biodiesel. The DOI participants shall comply with the accreditation, notification and reportorial requirements prescribed in DOE DC No. DC2021-06-0014, otherwise known as the “Revised Circular on Accreditation and Submission of Notices and Reports by Refiners, Importers, and Own Users of Gasoline and Diesel Pursuant to the Biofuels Act,” with the following amended report to reflect the increase in the percentage of biofuel blend: Annex QRB-B or the Quarterly Reconciliation Report on the Biodiesel Blending Compliance for three percent (3%), four percent (4%), and five percent (5%) blend. 5.2 Bioethanol. a. The DOI participants implementing the mandatory ten percent (10%) bioethanol blend shall comply with the accreditation, notification and reportorial requirements prescribed in DOE DC No. DC2021-06-0014, otherwise known as the “Revised Circular on Accreditation and Submission of Notices and Reports by Refiners, Importers, and Own Users of Gasoline and Diesel Pursuant to the Biofuels Act”. b. A DOI participant offering consumers gasoline containing the twenty percent (20%) bioethanol blend is required to submit to the DOE-Oil Industry Management Bureau (OIMB) the following notifications and reports containing information on the twenty percent (20%) bioethanol blend implementation: i. Preparatory Requirements. 6.1 Downstream Oil Industry. The downstream oil industry shall implement measures to ensure that all requirements for the transition to the higher biofuel blend are in place on or before the date set in this DC for diesel, and for gasoline, on or before the twenty percent (20%) bioethanol blend is offered to customers. a. Refinery, Depot, and Import Terminal. Among others, the DOI participants shall implement the following: 1. Sufficient and compatible storage capacity to accommodate the expected increase in biofuel supply; 2. Sufficient blending facility and implementation of accurate blending procedure; and 3. Sufficient and compatible transport system to accommodate the delivery of higher biofuel blend. b. Retail Outlets. If a DOI participant implements the twenty percent (20%) bioethanol blend, it shall: 1. Provide for dedicated storage tank; 2. Provide for dedicated dispensing pump; 3. Ensure the conspicuous posting at the dispensing pumps of the required advisory stickers as provided in the DOE DC implementing E-gasoline fuel (E20) specifications; and 4. Give proper precautions and inform the vehicle owner of the advisory before proceeding with dispensing the E20 gasoline to the vehicle. 6.2 Biofuel Producers. The biofuel producers shall ensure the requirements for the expected increase in demand for biofuel are met. Among others, the biofuel producers shall ensure the following: 1. Sufficient feedstock to produce or to meet the demand for higher biofuel blend; 2. Sufficient production to supply the demand for higher blend; 3. Sufficient and compatible storage capacity to accommodate the expected increase in biofuel supply; 5. Appropriate logistics in transporting and distributing biofuel products; and 6. Compliance with reportorial requirements under the Joint Administrative Order No. 2008-1 Series of 2008. Section 7. Mandatory NBB Review. The NBB shall review industry conditions following the full implementation of increasing biodiesel blend to B3 in 2024, B4 in 2025, and BS in 2026. Section 8. Separability Clause. Should any provision of this DC be subsequently declared invalid or unconstitutional, such parts that are not affected shall remain in full force and effect. Section 9. Repealing Clause. All other rules and regulations or parts thereof which are inconsistent with this DC are hereby repealed or modified accordingly. Section 10. Effectivity. This DC shall take effect fifteen (15) days after its publication in at least two (2) newspapers of general circulation.
