=== dc2022-03-0008-pages-001.ppm === ots Republic of the Philippines DEPARTMENT CIRCULAR NO. _ D©2022 - 03 - 0008 »j ADOPTION OF TRAINING REGULATIONS AND PRESCRIBING CERTIFICATION PROCESS FOR TRAINING INSTITUTIONS AND ENERGY MANAGERS (EMs) WHEREAS, Section 2 of Republic Act No. (RA) 7638 or the “Department of Energy (DOE) Act of 1992” states that it is the policy of the State to ensure a continuous, adequate, reliable, and economic supply of energy through, among others, judicious conservation, renewal, and efficient utilization of energy, to keep pace with the country’s growth and economic development; WHEREAS, Section 3 of the RA No. 11285 or the “Energy Efficiency and Conservation Act" (EEC Act) provides for the establishment of a framework for introducing and institutionalizing fundamental policies on energy efficiency and conservation, including the promotion of efficient and judicious utilization of energy, increase in the utilization of energy efficiency and renewable energy technologies, and the delineation of responsibilities among various government agencies and private entities; WHEREAS, Section 5(I) of EEC Act directs the DOE to initiate and maintain collaborative efforts with the business sector, particularly the commercial, industrial, transport, and power sectors, to ensure compliance with the EEC Act and broaden and enhance their efficient and judicious utilization of energy; WHEREAS, Section 49 of Department Circular (DC) No. DC2019-11-0014 or the “Implementing Rules and Regulations of EEC Act” (EEC-IRR) provides for the establishment of system for the assessment and certification of energy conservation officers and energy managers by relevant agencies towards raising the professional standards of those engaged in energy management; WHEREAS, Section 51 of the EEC-IRR states that Certified Energy Managers (CEM) must pass the certification, examination, and assessment for the development of the DOE in consultation with the relevant government and industry stakeholders. Furthermore, as a continuing qualification, the CEM must undergo energy efficiency and conservation seminars conducted by the DOE or any third-party institution duly approved by the DOE; WHEREAS, Sections 63 and 66 of the EEC-IRR classifies Designated Establishments (DEs) based on their respective energy consumption for the previous year and provide for their obligations, which include, among others, conducting an energy audit and employing a Certified Energy Conservation Officer (CECO) and CEM; WHEREAS, Memorandum Circular (MC) No. MC2020-05-0001 (“Directing All Designated Establishments under Commercial, Industrial, and Transport Sectors to Submit Energy Consumption Reports”) reiterates the obligations of DEs under the EEC-IRR to employ a CEM for entities with an Annual Energy Consumption of more than 4,000,000 kWhE; WHEREAS, DC No. DC2021-01-0001 prescribes the guidelines for the qualifications, assessment, registration, and certification of Energy Conservation Officers (ECO), Energy Managers (EM), and Energy Auditors (EA) covering DEs under MC No. MC2020-05-0001; Ed DC on Adoption of Training Regulations and Prescribing Certification Process for Training Institutions Page 1 of 7 and Energy Managers (EMs) K === dc2022-03-0008-pages-002.ppm === WHEREAS, the DOE together with the Department of Science and Technology — Industrial Technology Development Institute (DOST-ITDI), Commission on Higher Education (CHED), Technical Education and Skills Development Authority (TESDA), ENPAP 4.0 Inc., Meralco Power Academy (MPA), Philippine Institute of Energy Management Professionals, Inc. (PIEMPI), and Philippine Energy Efficiency Alliance (PE2), established a Technical Working Group (TWG) for the development of the training regulations (TR) for Energy Management on 22 July 2021; and WHEREAS, the DOE conducted virtual public consultations attended by various stakeholders on 22 December 2021 and 27 January 2022 to present the draft Department Circular and to consolidate the inputs from stakeholders in Luzon, Visayas, and Mindanao. NOW, THEREFORE, for and in consideration of the foregoing premises the DOE hereby orders the following: Section 1. Title. This DC shall be known as the “Energy Manager Certification Process.” Section 2. Scope and Coverage. This DC shall prescribe the following: 2.1 TR for the Certification of EMs; 2.2 Recognition of Training Institutions to implement the TR; and 2:3 Guidelines on the assessment, registration, certification, and recertification of EMs. Section 3. Definition of Terms. As used in this Department Circular, the following terms shall be understood to mean: 3.1 “Candidate” refers to a person applying as a CEM. 3.2 “CEM” refers to a professional who is a graduate of a four (4) year course, who obtains a certification as a CEM after demonstrating high levels of experience, competence, proficiency, and ethical fitness in the energy management profession, and who shall be chosen by Type 2 DE to plan, lead, manage, coordinate, monitor, and evaluate the implementation of sustainable energy management within their organizations. 3.3 “Recognized Training Institutions (RTI)” refers to recognized entities who complied with the requirements identified by the DOE in this Department Circular. RTI are the only entities eligible to conduct prescribed training for CEM. 3.4 “TR” refers to the promulgated document that serves as the basis for which the competency-based curriculum and instructional materials and competency assessment tools are developed. 3.5 "Type 1 DE” refers to a DE with an annual energy consumption of 500,000 kilowatt- hours (kWh) to 4,000,000 kWh for the previous year, or as may be adjusted by the DOE. 3.6 “Type 2 DE” refers to a DE with an annual energy consumption of more than 4,000,000 kWh for the previous year, or as may be adjusted by the DOE. Section 4. Adoption of the TR. The TR (Annex A) for CEM, developed by the DOE and its partner stakeholders, shall institutionalize the qualifications, certification process, training content, and training requirements for the certification of qualified EMs. DC on Adoption of Training Regulations and Prescribing Certification Process for Trainings Institutions Page 2 of 7 and Energy Managers (EMs) Kr === dc2022-03-0008-pages-003.ppm === Section 5. Recognition of Training Institutions. The DOE shall recognize and certify RTI based on the following requirements: 5.1 5.2 5.3 5.4 5.5 5.6 5.7 5.8 5.9 5.10 5.11 Duly Accomplished Training Institution Application Form (Annex B); Certified True Copies of Documents on Corporate Personality (e.g., SEC Registration and Articles of Incorporation); Corporate Ownership/Management which includes list of names of officers, personnel, and their position; Proof of ownership/lease of an actual training facility/building; List of equipment/machineries and other instructional materials, whether owned or leased; Certified True Copy of Business Registration; Certified True Copy of Business Permits; List of Lecturers/Instructors with Curriculum Vitae (CV)/Professional Regulation Commission (PRC) License (if applicable); List of trainings provided; Training Plan for CEM with corresponding number of days and fees; and Proof of payment of Ten Thousand Pesos (PHP 10,000.00) for Application Fee for Recognition. Certificate of RTI shall be valid for three (3) years. Application for registration shall undergo the procedure stated in Annex C. The evaluation of application shall be conducted through desk evaluation and/or visit, if necessary, to verify the veracity and existence of listed requirements. Section 6. Responsibilities of the RTI. The following shall be the responsibilities of the RTI: 6.1. Ensure compliance to the TR for CEM; 6.2 Assess the qualifications and eligibility of training applicants. RTI should ensure that all training graduates are qualified for certification; 6.3. Observe quality, fairness, and professionalism in the conduct of training and examination; 6.4 Provide affordable training fees to all Candidate; 6.5 Submit annual report, including graduates, to the DOE on or before 01 April based on the prescribed template in Annex D; and 6.6 Comply with all the requirements under the EEC Act, EEC-IRR, this Department Circular, and all other policies governing the Training and Development of Professionals in the Philippines. Qualifications of CEM. As embodied in Section 51 of the EEC-IRR, the following are the qualifications of a CEM: 7.1 7.2 Must be a licensed engineer, or a graduate of a four (4) year course or its equivalent with at least three (3) years of continuous hands-on experience in the installation, operation, and maintenance of energy-consuming machines and equipment in facilities with energy consumption for Type 2 DEs, proof of which shall be submitted to the DOE; and Must pass the certification examination and assessment for the development of the DOE in consultation with the relevant government industry stakeholders. As a continuing qualification, the CEM must undergo energy efficiency and conservation seminars conducted by the DOE or any-third party institution duly approved by the DOE. Section 8. Application for Certification of Energy Managers. The Candidate shall submit the following documents to the DOE: 8.1 8.2 8.3 8.4 8.5 8.6 8.7 Duly accomplished Application Form (Annex E); Certified True Copy of PRC License (if applicable); Certified True Copy of Diploma and Transcript of Records; Endorsement letter from his/her supervisor or other authorized representative of the Type 2 DE; Proof of Experience duly certified by the human resource management head or similar office; Sworn statement of the applicant in discharging functions of EMs (Annex F); and Proof of payment of One Thousand Pesos (PHP 1,000.00) for Application Fee for Certification. All documents shall be submitted in accordance with the submission guidelines of the DOE under Annex G. Application for Certification shall follow the procedure stated in Annex H. Section 9. Responsibilities of CEM. As provided under Section 5 of DC2021-01-0001, all CEMs shall have the following responsibilities: 9.1 9.2 Manage the energy consumption of facilities, equipment, and devices; Administer the following: 9.2.1 Implementation and improvement of energy efficiency measures; 9.2.2 Conduct of regular energy audit; 9.2.3 Energy monitoring and control; and 9.2.4 Preparation and regular review of periodic energy consumption and energy conservation program reports. pS DC on Adoption of Training Regulations and Prescribing Certification Process for Trainings Institutions Page 4 of 7 and Energy Managers (EMs) K === dc2022-03-0008-pages-005.ppm === 9.3. Such other responsibilities under the EEC Act, EEC-IRR, and this Department Circular. Section 10. Validity of Certification. The Certification shall be valid for three (3) years. After which, recertification will be processed after the CEM completes a number of professional development units similar to PRC or through specialized or advanced training from RTI. The recertification will be valid for the next three (3) years and continuing qualifications shall be based on the TR of the DOE. Section 11. Transitory Provisions for EMs with Existing Certifications. An EM with an existing certification from international and/or local organizations/bodies, such as ASEAN Center for Energy (ACE), Association of Energy Engineers (AEE), Energy Management Association (EMA), United Nations Industrial Development Organization (UNIDO) and equivalent will be granted the initial Certification valid for three (3) years: Provided That, all items in Section 8 of this Department Circular, must be complied with. In lieu of the Certificate of Training Completion under Section 8 of this Department Circular, the applicant must submit a Certificate of Completion, or a similar Certification, together with the coursework, from the international and/or local organizations/bodies: Provided Further That, attendance on the existing certification from international and/or local organizations/bodies shall be on or before the effectivity of this Department Circular. Section 12. Continuous Professional Development (CPD). Recognizing the continuous advancements in the energy efficiency and conservation, renewable energy technologies, and systems and practices, the Energy Utilization Management Bureau (EUMB) shall support the subsequent adoption of CPD for EMs following established local methodology & practice: Provided That, the same will be properly coordinated with the involved government agencies such as the PRC in consonance with RA 10912 or the “Continuing Professional Development Act of 2016”. Section 13. RT| and CEM Database. The DOE-EUMB shall develop and manage a centralized database that will provide the list of all RTIs and CEMs. Only those RTI that are in the list will be allowed to conduct training for Candidates. Section 14. Outstanding CEM. Pursuant to Department Order No. DO2021-09-0014 entitled “Guidelines on Energy Efficiency Excellence Awards”, the DOE shall recognize outstanding CEMs who is responsible in the successful implementation of a sustainable energy management system and energy efficient projects and programs in their DEs and for consistently showing significant improvement in the energy efficiency of the entity they are managing over a period of time. Section 15. Monitoring, Evaluation, and Review. To ensure continuous quality improvements of the Certification and Recognition procedures, the DOE, through the EUMB, will conduct annual monitoring and evaluation of RT| and CEM. For this purpose, the EUMB shall issue guidelines for the procedures for the review and adoption of improvements and rules of this Department Circular, including the TR: Provided That, the guidelines shall only be issued after public consultation. Section 16. Visitorial Powers. The DOE shall be eligible to conduct spot checks and unscheduled visits to RTI during office hours to ensure their compliance to the TR on Energy Management and the provisions under this Department Circular. The DOE may also opt to conduct audits and evaluation procedures during the visit. Section 17. Transitory Provision. Upon effectivity of this Department Circular, all Training Institutions will be given one (1) year to apply for recognition to the DOE. Section 18. Prohibited Acts. The CEM and RTI shall be subjected to the penalties for violation of the following: 18.1 Failure of RTI to comply with the responsibilities under Section 6 of this Department Circular; 18.2 Failure of CEM to comply with the responsibilities under Section 9 of this Department Circular; 18.3 Failure of CEM to register with the required copy of a PRC license (when applicable) and document/s that would provide proof of continuous hands-on experience in the installation, operation, and maintenance of energy-consuming machines and equipment in facilities with energy consumption for Type 2 DE; 18.4 Failure of CEM to comply with the mandatory energy efficiency and conservation seminars conducted by the DOE or any third-party institution duly approved by the DOE; 18.5 Training Institution providing trainings without recognition; 18.6 Failure to provide accurate information or the provision of false or misleading information as required by this Department Circular; 18.7 Willfully refusing to submit to an on-site inspection; and 18.8 Failure to comply with issued orders of the DOE in discharge of its enforcement powers. Section 19. Fines and Penalties. The DOE is empowered to impose fines and penalties for any violation of the prohibited acts enumerated under Section 18 of this Department Circular. The schedule of fines and penalties is attached as Annex / of this Department Circular. After due process, the revocation of the recognition and certification may likewise be accompanied by the blacklisting of the CEM and/or RTI. Section 20. Quality Assurance Review. The DOE shall periodically review, update, and issue necessary rules relative to the development and prescribed TR for CEM every three (3) years from the date of issuance, or earlier as the need arises. Section 21. Amendment Clause. The DOE may revise and supplement and issue related guidelines, circulars, and other subsidiary issuance as it deems necessary for the effective implementation of the various provisions of this Department Circular. Section 22. Repealing Clause. The provisions of other circulars, orders, issuances, rules, and regulations, which are inconsistent with the provisions of this Department Circular, are hereby repealed, amended, modified, or superseded accordingly. Section 23. Separability Clause. If for any reason, any section or provision of this Department Circular is declared unconstitutional or invalid, such parts not affected shall remain in full force and effect. Training Content Requirement 3.1. DOE Technical Working Group (TWG) shall finalize the Training Content Requirement for each CEM course. 3.2 Each RTI shall submit to DOE its Training Plans to comply with the Training Course Requirement each for CEM courses for approval. 3.3.
