=== dc2022-03-0006-pages-01.ppm === \ DEPARTMENT CIRCULAR NO. 002022 - 03-000@ ,, ADOPTION OF TRAINING REGULATIONS CERTIFICATION PROCESS FOR ENERGY AUDITORS (EAs) WHEREAS, Section 2 of Republic Act No. (RA) 7638 or the “Department of Energy (DOE) Act of 1992” states that it is the policy of the State to ensure a continuous, adequate, reliable, and economic supply of energy through, among others, judicious conservation, renewal, and efficient utilization of energy, to keep pace with the country’s growth and economic development; WHEREAS, Section 3 of the RA No. 11285 or the “Energy Efficiency and Conservation Act” (EEC Act) provides for the establishment of a framework for introducing and institutionalizing fundamental policies on energy efficiency and conservation, including the promotion of efficient and judicious utilization of energy, increase in the utilization of energy efficiency and renewable energy technologies, and the delineation of responsibilities among various government agencies and private entities; WHEREAS, Section 5(!) of EEC Act directs the DOE to initiate and maintain collaborative efforts with the business sector, particularly the commercial, industrial, transport, and power sectors, to ensure compliance with the EEC Act and broaden and enhance their efficient and judicious utilization of energy; WHEREAS, Section 54 of Department Circular (DC) No. DC2019-11-0014 or the “Implementing Rules and Regulations of Republic Act No. 11285 (Energy Efficiency and Conservation Act)” or the EEC-IRR states that the DOE, in consultation with the Technical Education Skills Development Authority (TESDA) and relevant stakeholders, shall develop guidelines for the certification of EAs; WHEREAS, DC No. DC2021-01-0001 prescribes the Guidelines for the Qualifications, Assessment, Registration, and Certification of Energy Conservation Officers (CECO), Energy Managers (CEM), and EAs covering Designated Establishments under Memorandum Circular No. MC2020-05-0001 (‘Directing All Designated Establishments Under Commercial, Industrial, and Transport Sectors to Submit Energy Consumption Reports’); WHEREAS, the DOE together with TESDA, Department of Science and Technology - Industrial Technology Development Institute (DOST-ITDI), ENPAP 4.0 Inc., Meralco Power Academy (MPA), Philippine Institute of Energy Management Professionals, Inc. (PIEMPI), and Philippine Energy Efficiency Alliance (PE2), established a Technical Working Group (TWG) for the development of the training regulations for EAs on 22 July 2021; WHEREAS, the DOE conducted public consultations attended by various stakeholders on 22 December 2021 and 27 January 2022 to present the draft Department Circular and to consolidate the inputs from stakeholders in Luzon, Visayas, and Mindanao; and WHEREAS, the adoption of the Training Regulations for Energy Auditors will lead to energy efficiency. ne eye DC on Adoption of Training Regulations Certification Process for Energy Auditors (EAs) Page 1 of 6 === dc2022-03-0006-pages-02.ppm === NOW, THEREFORE, for and in consideration of the foregoing premises and according to its mandate under the EEC Act and its implementing rules and regulations, the DOE hereby orders the following: Section 1. Title. This Department Circular shall be known as the “Energy Auditor Certification Process”. Section 2. Scope. This Department Circular shall cover the following: a. Training Regulations (TR) for the certification of Energy Auditors; b. Recognition requirements and processes of qualified Training Institutions to implement the developed TR; and c. Guidelines on the assessment, registration, and certification of EAs to the DOE. Section 3. Definition of Terms. As used in this Department Circular, the following terms shall be understood to mean: a. “Candidate” refers to a person applying as a Certified Energy Auditor (CEA). b. “Energy Audit” refers to the evaluation of energy consumption and review of current energy cost to determine appropriate intervention measures and efficiency projects in which energy can be judiciously and efficiently used to achieve savings. c. “Energy Audit Report” refers to a document that provides all the evaluation findings and identified energy-saving recommendations from the conducted energy audit activities by an Energy Auditor or an Energy Service Company (ESCO). d. “Designated Establishments (DE)” refers to a private or public entity in the commercial, industrial, transport, power, agriculture, public works, and other sectors identified by the DOE as energy intensive industries based on their annual energy consumption in the previous year or an equivalent index. e. “Recognized Training Institutions (RTI)” refers to recognized entities who complied with the requirements identified by the DOE in this Department Circular. RTI are the only entities eligible to conduct the prescribed training programs for EAs. f. “Training Regulations (TR)’ refers to the promulgated document that serves as the basis for which the competency-based curriculum and instructional materials and competency assessment tools are developed. Section 4. Conduct of Energy Audit. Energy Audits shall be conducted by trained and certified EAs of DOE and shall be carried out to the following: a. Designated Establishments during their first year of report submission and every three (3) years, thereafter. This is in strict compliance with Section 66(g) of the EEC- IRR and the issued DOE Memorandum Circular No. MC2020-05-0001; and b. Energy Efficiency (EE) Projects to be applied for endorsement for Fiscal Incentives availment with the DOE. All Energy Audit Reports shall be submitted to both the client establishment and the DOE alongside the other requirements based on applicable provisions under MC2020-05-0001, DC2021-05-0011 (“Guidelines for the Endorsement of Energy Efficiency Projects to the Board EE -=e-aPe He DC on Adoption of Training Regulations Certification Process for Energy Auditors (EAs) Page 2 of 6 fF === dc2022-03-0006-pages-03.ppm === of Investments (BOI) for Fiscal Incentives”), and subsequent issuances under the EEC Act and its IRR. Energy Auditors shall provide independent evaluation of the audited facility/entity and communicate their findings and recommendations to said Energy Audit Reports. Section 5. Classification of Energy Auditors. The EAs shall be classified as follows: a. Energy Auditor refers to an individual with experience and knowledge on using/operating energy audit equipment for the conduct of all levels of energy audit. This may refer to a company’s hired/appointed energy auditor and/or a private independent consultant; and b. Recognized Energy Auditor refers to the following: i. Energy Auditors who are already certified by a duly recognized local or international third-party certifying body for energy auditors prior to the effectivity of this Department Circular. These Energy Auditors shall be subjected to further technical evaluation of DOE and shall comply with the requirements for certification under this Department Circular. ii. | Energy Audit Team of the DOE - Energy Utilization Management Bureau (DOE- EUMB) or its duly authorized/deputized representative(s) from another government agency or from a private energy service provider who shall conduct unannounced inspection of any Government Entity (GE) or government facility for the purpose of checking, monitoring, and evaluating their energy consumption, among others, and to verify the energy conservation and efficiency programs as provided by the IAEECC Resolution No. 1, s. 2020 and its subsequent resolutions. Section 6. Responsibilities of Energy Auditors. The responsibilities of EAs shall: a. Conduct energy audits to determine ways to optimize the energy performance of Designated Establishments; b. Evaluate the level of implemented energy management systems and programs, identify the gaps in the aforementioned systems and programs, and suggest ways to ensure sustainable energy performance improvement for a Designated Establishment; c. Provide audit/technical reports to the Certified Energy Conservation Officer (CECO) or Certified Energy Manager (CEM) of the Designated Establishment; and d. Perform such other responsibilities under the EEC Act, EEC-IRR, and this Department Circular. Section 7. Professional Competency of Energy Auditors. The Training Regulations (Annex A) for EAs, developed by the DOE and its partner stakeholders, shall institutionalize the guidelines, qualifications, certification process, training content, and training requirement for the awarding of Certificate to a qualified Energy Auditor. Section 8. Continuing Professional Development (CPD). Recognizing the continuous advancements in the energy efficiency and conservation and renewable energy technologies, systems, and practices, the EUMB shall support the process of adopting Continuing Professional Development (CPD) later for Energy Auditors following the successful CPD model and approach in the country: Provided that, any CPD will be properly coordinated with the involved government agencies such as the Professional Regulation Commission (PRC) in SY DC on Adoption of Training Regulations Certification Process for Energy Auditors (EAs) Page 3 of 6 Fa === dc2022-03-0006-pages-04.ppm === consonance with Republic Act No. 10912 or the “Continuing Professional Development Act of 2016”. Section 9. Certification for Individual Auditors. The Candidate shall submit the following documents to the DOE for Certification: a. Duly accomplished Certified EA Application Form (Annex B); b. Certified True Copy of PRC License (when applicable); c. Proof of Experience (Certificate of Project Completion, Endorsement Letters, or any document that will support the claim on the proof of experience); d. For graduates of K-12 Academic Track of Science, Technology, Engineering, and Mathematics (STEM), Transcript of Records and/or Diploma; and e. Proof of payment of One Thousand Pesos (PHP 1,000.00) for the Application Fee for Certification. The Certifications shall be valid for three (3) years. After which, recertification will be processed after the EA completed the training from an RTI. The recertification will be valid for the next three (3) years and continuing qualifications shall still be based on the TR of the DOE. All documents shall be submitted based on the submission guidelines of the DOE under Annex C. Application for Certification shall follow the procedure stated in Annex D. Section 10. Recognition of Training Institutions. The DOE shall recognize and certify Training Institutions based on the following requirements: a. Duly Accomplished Training Institution Application Form (Annex E); b. Certified True Copies of Documents proving Corporate Personality (e.g., SEC Registration and Articles of Incorporation); c. Corporate Ownership/Management which includes the list of names of officers, personnel, and their position (Annex F); d. Proof of ownership/lease of an actual training facility/building; e. List of equipment/machineries and other instructional materials; f. Certified True Copy of Business Registration; g. Certified True Copy of Business Permits; List of Lecturers/Instructors with CVs; i. List of trainings provided; j. Training Plan for EAs with corresponding number of days and fees; and k. Proof of payment of Ten Thousand Pesos (PHP10,000.00) for the Application Fee for Recognition. Recognition of the Training Institutions shall be valid for three (3) years. The evaluation of the application shall be conducted through desk evaluation and/or visit, if necessary, to verify the veracity and existence of the listed requirements. Application for Recognition shall follow the procedure stated in Annex G. Section 11. Responsibilities of the RTI. The following shall be the responsibilities of the RTI: a. Ensure compliance to the Training Regulations of the DOE; b. Assess the qualifications and eligibility of training applicants; c. Observe quality, fairness, and professionalism in the conduct of training and examination; d. Provide affordable training fees to all Candidates; e. Submit an annual report, including a list of graduates, to the DOE on or before 01 April based on the prescribed template in Annex H; and f. Comply with all the requirements under the EEC Act, its IRR, this Department Circular, and all other policies governing the Training and Development of Professionals in the Philippines. Section 12. Energy Auditor Registry. The DOE shall develop and manage a centralized database that will provide the list of all RT| and CEA. Only those RTI that are in the list will be allowed to conduct trainings to Candidates. Likewise, only CEAs will be recommended to Designated Establishments as experts for energy audit together with Energy Service Companies (ESCOs). Section 13. Recognition Program for Outstanding Certified Energy Auditors. Pursuant to Department Order No. DO2021-09-0014 or the “Guidelines on Energy Efficiency Excellence (EEE) Awards’, the DOE shall recognize outstanding CEAs who have enabled and facilitated the identification of the energy performance measures and action plans, mitigated potential issues, risks, and other negative impacts to the entity he/she is managing. He/she should have earned significant positive client feedback and recognition coupled with outstanding energy performance contribution. Section 14. Monitoring, Evaluation, and Review. To ensure the continuous quality improvements of the Certification and Recognition procedures, the DOE through the EUMB will conduct annual monitoring and evaluation of RT| and CEA. For this purpose, the EUMB shall issue guidelines for the procedures for the review and adoption of improvements and rules of this DC, including the TR: Provided That, the guidelines shall only be issued after public consultation. Section 15. Quality Assurance Review. The DOE shall periodically review, update, and issue necessary rules relative to the development and adoption of Training Regulations for CEA every three (3) years from the date of issuance or earlier as the need arises. Section 16. Visitorial Powers. The DOE shall be eligible to conduct spot checks and unscheduled visits to RTI during office hours. The DOE may also opt to conduct audits and evaluation procedures during the visit. Section 17. Transitory Provision. Upon effectivity of this Department Circular, all Training Institutions and EA will be given one (1) year to apply for recognition and certification from the DOE. Failure to comply with the requirements of the DOE will result in non-recognition of the DOE to the institution or EA. An EA with an existing certification from international and/or local organizations/bodies, such as the ASEAN Center for Energy (ACE), shall apply for Certification and will be granted the EO DC on Adoption of Training Regulations Certification Process for Energy Auditors (EAs) Page 5 of 6 === dc2022-03-0006-pages-06.ppm === initial Certification valid for three (3) years: Provided That, all items in Section 9 of this Department Circular must be complied with. In lieu of the Certificate of Training Completion under Section 9 of this Department Circular, the applicant must submit a Certificate of Completion, or a similar Certification, together with the coursework, from the international and/or local organizations/bodies; Provided Further That, attendance on the existing certification from the international and/or local organizations/bodies shall be on or before the effectivity of this Department Circular. Section 18. Prohibited Acts and Penalties. The EA and RTI shall be subjected to the penalties for violation of the following: a. Failure of RTI to comply with the responsibilities set forth under Section 11 of this Department Circular; b. Failure of EA to comply with the responsibilities set forth under Section 6 of this Department Circular; c. RTI who conducts trainings and/or similar seminars related to the DOE Training Regulations without recognition; d. Failure to provide accurate information or the provision of false or misleading information as required by this Department Circular; and e. Failure to comply with issued orders of the DOE in discharge of its enforcement powers. The DOE is empowered to impose fines and penalties for any violation of the above prohibited acts. The schedule of fines and penalties is attached as Annex / of this Department Circular. After due process, the revocation of the certification or recognition may likewise be accompanied by the blacklisting of the EA and/or RTI. Section 19. Amendment Clause. The DOE may revise, supplement, and issue related guidelines, circulars, and other subsidiary issuance as it deems necessary for the effective implementation of the various provisions of this Department Circular. Section 20. Repealing Clause. The provisions of other circulars, orders, issuances, rules, and regulations, which are inconsistent with the provisions of this Department Circular are hereby repealed, amended, modified, or superseded accordingly. Section 21. Separability Clause. If for any reason, any section or provision of this Department Circular is declared unconstitutional or invalid, such parts not affected shall remain in full force and effect. Section 22. Effectivity. This Department Circular shall take effect immediately following its publication in at least two (2) newspapers of general circulation.
