SUPPLEMENTING DEPARTMENT CIRCULAR NO. DC2019-12-0018'
BY INCLUDING THE NATIONAL TRANSMISSION CORPORATION IN THE
MEMBERSHIP OF THE ANCILLARY SERVICES — TECHNICAL WORKING

GROUP

WHEREAS, on 04 December 2019, the Department of Energy (DOE) !ssued
Department Circular No. DC2019-12-008 entitled “Adopting A General Framework
Governing the Provision and Utilization of Ancillary Services in the Grid”;

WHEREAS, Section 9 of DC2019-12-0008 provided for the creation of an
Ancillary Services - Technical Working Group (AS-TWG), mandated to assist the
DOE in implementing the provisions of the said Circular;

WHEREAS, Ancillary Services (AS) are intended, primarily, to protect and
maintain the stability, security and integrity of the power system;

WHEREAS, the National Transmission Corporation (TRANSCO), which was
created under Republic Act 9136, otherwise known as the Electric Power Industry
Reform Act (EPIRA), was the government instrumentality which performed and
was mandated to develop, operate, and maintain the country’s power
transmission assets and to act as System Operator to provide AS before these
responsibilities were privatized in 2009;

WHEREAS, while the congressional franchise to operate the transmission
network was awarded to the National Grid Corporation of the Philippines (NGCP-, )
ownership of all transmission assets still remains with the Philippine government
through the TRANSCO;

WHEREAS, maximizing the involvement and participation of TRANSCO in the
discussion and resolution of issues pertaining to AS is a rational and sensible
policy;

NOW, THEREFORE, in consideration of the foregoing premises and pursuant to
its authority under existing laws, the DOE, in order to enhance the provisions of
Department Circular No. DC2019-12-0018, hereby promulgates and adopts the
following supplementary policies:

Section 1. Designating TRANSCO as Additional Member of the AS-TWG, In
order to further strengthen and enhance the policy-making, operational and
technical capability of the AS-TWG, created under Section 9 of Department
Circular No. DC2019-12-0018, in the performance of its assigned tasks and

functions, TRANSCO is hereby designated as an additional! member of the said
body.

As one of the members of the AS-TWG, TRANSCO shall perform the functions
and responsibilities assigned to it in accordance with the provisions of the above-
mentioned Circular, as well as with existing laws, rules and regulations.

Section 2. Repealing Clause. Ai! rules, regulations and guidelines inconsistent
with the provisions of this Circular are hereby repealed, amended or modified
accordingly.

Section 3. Effectivity. This Circular shall take effect immediately upon publication
in the newspaper of general circulation. Copies thereof shall be filed with the
University of the Philippines Law Center — Office of National Administrative
Register (UPLC-ONAR).
