No. 7638, otherwise known as “An Act Creating the Department of Energy (DOE)’, tasks the DOE to formulate rules and regulations as may be necessary to guide the operations of both government and private entities involved in energy resource supply and distribution; WHEREAS, Republic Act No. 8749, otherwise known as the “Philippine Clean Air Act of 1999”, mandates the use of environmentally clean fuels which meet specified emission standards and directs the DOE, together with the Department of Environment and Natural Resources (DENR), Bureau of Product Standards (BPS), and the Department of Science and Technology (DOST) and other stakeholders, to set specifications for all types of fuel and fuel-related products and improve fuel composition; WHEREAS, in accordance with the above mandate, the DOE has developed, reviewed and subsequently promulgated by BPS the PNS/DOE QS 005:2016 and PNS/DOE QS 012:2016 as the latest and current standard specifications for liquefied petroleum gases for non-motor fuel and motor fuel respectively, superseding PNS/DOE QS 005:2005; WHEREAS, in this latest revision, the PNS for LPG was split into two general applications, namely as motor and non-motor fuel (domestic, commercial and industrial fuel), and improvements are made in the requirements on the use of odorants for health and safety considerations in both PNS; NOW, THEREFORE, the following guidelines are hereby adopted to effectively implement the Philippine National Standard for Liquefied Petroleum Gases: Section 1. Standard Implementation. Upon the effectivity of this Department Circular, only Liquefied Petroleum Gases conforming to PNS/DOE QS 005:2016 and PNS/DOE QS 012:2016 shall be allowed for sale at the bulk and retail levels in the country. Section 2. Quality Monitoring. Section 3. Penalties / Sanctions. Any person who fails to comply with the provisions of this Department Circular shall be subject to appropriate sanctions imposed under applicable laws and implementing rules and regulations. Section 4. Repealing Clause. All circulars and other issuances not consistent with this Circular are hereby deemed modified or repealed accordingly. Section 5. Separability Clause. If for any reason, any section or provision of this circular is declared unsconstitutional or invalid, such parts not affected shall continue to remain in full force and effect. Section 6. Effectivity and Publication. This Department Circular shall be effective upon its publication in two (2) newspapers of general circulation and shall remain in effect until revoked.
