=== dc2019-02-0005-pages-1.ppm === Republic of the Philippines DEPARTMENT OF ENERGY DEPARTMENT CIRCULAR NO, 0C20/9-02- 2000 PROPER RETENTION OF DUPLICATE LIQUID PETROLEUM FUEL SAMPLES IN DEPOTS AND RETAIL OUTLETS WHEREAS, Rule V, Sections 19 and 20 of Department Circular No. 2017-11-0011 (Promulgating a Revised Rules and Regulations Governing the Business of Retailing Liquid Fuels), requires all industry players engaged in the marketing of liquid petroleum fuels to provide in their place of business sample bottles for use in retaining duplicate samples taken in the course of inspection made by representatives of the Department of Energy (DOE); WHEREAS, the American Society for Testing and Materials (ASTM) D4057-95 (Standard Practice for Manual Sampling of Petroleum and Petroleum Products) provides for the type of bottle to be used as container for petroleum and petroleum product samples. WHEREAS, pursuant to Memorandum Circular No. 2001-02-001, retention of duplicate samples by the service stations is accordingly institutionalized in the product quality monitoring procedure of the DOE. Access to the retained duplicate samples is allowed to settle, with finality, contested DOE-National Petroleum Testing Laboratory test results on DOE-held samples. NOW, THEREFORE, Industry players are enjoined to observe the following guidelines in retaining duplicate samples at the depot and retail outlets: Section 1. Minimum volume of the retained duplicate sample per product shall be one liter. Section 2. integrity of the retained duplicate samples shall be ensured through the following procedures: A. Appropriate labeling and sealing of sample shall be made by OIMB inspector indicating important information including product name and date taken. B. The sealed samples shall be stored in a safe and preferably cool place not exposed to light to preserve its properties. D. Disposition of the retained duplicate samples from depot shall be undertaken only upon receipt of the official letter from DOE permitting thereof or after three (3) months from the time the sample was taken. E. On the other hand, disposition of the duplicate samples from retail outlets shall be undertaken only upon receipt of the official letter from DOE permitting thereof or after three (3) months from the time the sample was taken. F. Sample bottles must be clean and shall have the following specifications: Description Specifications Cover Screw-cap; Orifice opening 1.0” (min) a Section 3. If, for any reason, any provision of this Circular is declared unconstitutional or invalid, such part or parts not affected shall continue to remain in full force and effect. Section 4. This Circular repeals Memorandum Circular No. 2001-02-001. Section 5. This Department Circular shall take effect fifteen (15) days from the date of its complete publication in two newspapers of general circulation and shall remain in effect until otherwise revoked and certified true copies thereof shall be filed with the University of the Philippines Law Center- Office of the National Administrative Register Issued at Energy Center, Bonifacio Global City, Taguig.
