=== dc2016-05-0006-pages-1.ppm === ge Republic of the Philippines el DEPARTMENT OF ENERGY DEPARTMENT CIRCULAR NO, 2C20|o- 05-900 jw IMPLEMENTING THE MODIFIED PHILIPPINE NATIONAL STANDARD SPECIFICATION FOR BIOFUELS — COCONUT METHYL ESTER (PNS/DOE QS 002:2015) nn WHEREAS, Republic Act No. (RA) 7638 or the “Department of Energy (DOE) Act tasks the DOE to formulate rules and regulations as may be necessary to guide the operations of both government and private entities involved in energy resource supply and distribution; WHEREAS, RA 8749 or the “Philippine Clean Air Act of 1999” directs the DOE together with the Department of Environment and Natural Resources (DENR), Bureau of Product Standards (BPS), and Department of Science and Technology (DOST) and other stakeholders, to set specifications for all types of fuel and fuel- related products and improve fuel composition; WHEREAS, RA 9367 or the “Biofuels Act of 2006” mandates the use of biofuels to reduce dependence on imported fuels with due regard to the protection of public health, the environment and natural ecosystems consistent with the country’s sustainable economic growth that would expand opportunities for livelihood; WHEREAS, the quality of biodiesel, also designated as Bi00, in the form of coconut methy! ester was standardized to ensure its effectiveness when used either in its pure state or as a blend based on local conditions as established through various test validations, in terms of the current requirements of the industry, its users and manufacturers and regional standard harmonization thrust; WHEREAS, technical concerns were established for the need to review Philippine National Standard (PNS)/DOE QS 002:2007 that resulted to the following improvements in the standard: Addition of Iodine Number as new property Increase in the minimum limit of Oxidation Stability property Reduction in the maximum Sulfur content Conduct of Cold Soak Filterability Test for data gathering purposes . WHEREAS, there is a need to supersede PNS/DOE QS 002:2007 to reflect the foregoing improvements in the quality standard specification for Coconut Methy! Ester. NOW, THEREFORE, the following guidelines are hereby adopted to effectively implement the PNS for Coconut Methy! Ester: Section 1. Standard Implementation. Upon the effectivity of this Department Circular, only Coconut Methyl! Section 2. Product Quality Certification. In order to protect against adulterated or off-specification products, it shall be the responsibility of the Coconut Methyl Ester supplier to ensure that all Coconut Methyl Ester deliveries are accompanied by a Certificate of Quality to be issued by same, indicating the properties of the delivered Coconut Methy! Ester, which should be in compliance with the PNS. Section 3. Penalties/Sanctions. Any person who fails to comply with the provisions of this Department Circular shall be subject to appropriate sanctions imposed under applicable laws and implementing rules and regulations. Section 4. Repealing Clause. All circulars and other issuances not consistent with this Department Circular are hereby deemed modified or repealed accordingly. Section 6. Separability Clause. If any provision of this Department Circular is declared invalid by any court of law or any competent authority, those provisions not affected shall remain valid and effective. Section 7.
