MOC: Downstream Oil, Gas and LPG

The only section of the folder that is not about electricity. Authority is split across four statutes rather than EPIRA: the Downstream Oil Industry Deregulation Act (Digest: RA 8479 — Downstream Oil Industry Deregulation Act of 1998 ), the LPG Industry Regulation Act (Digest: RA 11592 — LPG Industry Regulation Act of 2021 ), the Biofuels Act (Digest: RA 9367 — Biofuels Act of 2006 ), and the Philippine Natural Gas Industry Development Act (Digest: RA 12120 — Philippine Natural Gas Industry Development Act ), with BP 33 still supplying part of the enforcement basis. The natural gas chain is the cleanest three-step succession in the corpus — a 2017 administrative regulation, its 2024 amendment, and then a statutory IRR in 2025 — so read the current instrument unless the question is about a permit issued under an earlier one.

Belongs here: a circular regulating a fuel — its import, storage, transport, distribution, or retail — or the administrative procedure that enforces those rules. Natural gas as a power generation input is regulated by the ERC under EPIRA and belongs elsewhere.

Downstream natural gas

Operationalizes the Philippine Natural Gas Industry Development Act and establishes the Philippine Downstream Natural Gas Industry (PDNGI) as a statutory rather than administrative regime: the industry structure (LNG storage and regasification terminal, transmission, conventional and virtual distribution, and a virtual transportation system by land and sea), four participant categories, and permit validity running from a one-year notice to proceed to a 25-year permit to operate and maintain. Directs the DOE to issue a gas policy within six months, transmission, distribution, terminal and third-party-access codes within two years, and a development plan on a three-year review cycle — and, distinctively, to assess the stranded-asset risk of gas infrastructure against the renewable transition. LPG and downstream oil

  • Digest: DC2022-11-0037 (LPG Registration and License to Operate Guidelines)LPG registration and licence to operate. The primary implementing guidelines for RA 11592, covering eleven participant types from importer and refiner through refiller, dealer, retailer, auto-LPG station, and centralized piping system. Requires a certificate of registration before construction, trademark and cylinder-seal registration, and a site-specific five-year licence to operate, with participant duties on Philippine National Standards compliance, net weight and leak testing, device calibration, and a monthly-to-annual reporting calendar. Sets the DOE’s inspection, show-cause, preventive-suspension, revocation, closure, and confiscation powers, including 30-day determination and destruction of dangerously defective cylinders.
