Key Provisions
Terminology change: This IRR adopts “Permit Holder” terminology, replacing the “Operator” term used in DC2024-01-0007 [DC2025-04-0005, §4, 2025-03-26].
DNG-REC (§22): Created by this IRR; Chair = Supervising Usec OIMB; processes all permits and accreditations. DOE Secretary approval required only for PTC and POM. DNG-TWG (NGMD + LS + FS) evaluates in 12 working days; DNG-REC decides in 5 working days [DC2025-04-0005, §22/Annex A, 2025-03-26].
Permit sequence (§§20–21): NTP (1 yr) → PTC (per baseline schedule) → POM (25 yr max, renewable). POM requires onsite verification by DNG-TWG and IA-HSSE IMT (10 wd).
Participant categories (§17): Supplier, Aggregator, Bunker Trader, Reseller [DC2025-04-0005, §17, 2025-03-26].
Accreditation (§30): 5-year validity, renewable every 5 years; DNG-REC approval required.

Processing timelines vs. DC2024-01-0007: This IRR compresses evaluation/decision periods to 3 working days + 12 working days + 5 working days, down from the 15 calendar days + 45 calendar days + 15 calendar days baseline under the prior DC2024-01-0007 regime [DC2025-04-0005, Annex A, 2025-03-26].
Gas Policy deadline (§5(p), §60): DOE must issue Gas Policy within 6 months of IRR effectivity (~October 2025). Pending applications on aggregation and supply matters held in abeyance until Gas Policy issues.
Codes deadline (§5(g)): PDNG Transmission Code, Distribution Code, PLSR Terminal Code, and TPA Code within 2 years of IRR effectivity (~April 2027).
Fine schedule (§57): ₱500K (standards violation) / ₱1M (non-compliance with DOE orders) / ₱200K (reportorial failure) / ₱100K (other duties). Reviewed every 5 years.
Transition (§59): Existing facilities continue; Permit Holders and Participants have 2 years from IRR effectivity to comply with all Act provisions (~April 2027).
Repealing clause (§66): DC2024-01-0007 (Amended PDNGR) is repealed.
Saving clause (§67): PD 87, RA 9136 (EPIRA), and RA 9513 (RE Act) remain fully applicable.
