Key Provisions by Section

§8.2 (Eligibility): MGSP operation is not a public utility; no congressional franchise required. ATO + COC from ERC only. Open to private corporations, LGUs, cooperatives, NGOs, GenCos, and DUs/DU subsidiaries.

Two-track area identification (§§5–7):

  • Track 1: DOE-declared unserved/underserved areas
  • Track 2: DU-identified unserved areas included in LTER → submitted annually to DOE (by NEA for ECs by March 15)

§14.4.3 (DU right to match): DU has 7 calendar days to tender a lower all-in price after MGSP BAC publishes all bidder price offers. If DU matches, award goes to DU-operated microgrid; otherwise, lowest-priced MGSP wins subject to post-qualification.

§14.4.8 (Failed CSP): If no MGSP tenders an offer for a DU-identified area, DU must electrify via DU microgrid within 18 months from lapse of 30-day offer period.

§16.1 (NPC fallback): If DOE-declared area CSP fails, NPC continues missionary electrification within 18 months from funding availability.

§16.3 (NPC Graduation Plan): NPC submits comprehensive Graduation Plan to DOE within 180 days of IRR effectivity; updated annually. Identifies areas for DOE declaration as unserved/underserved (transition from SPUG to MGSP pipeline).

§17.5 (EVOSS timelines halved): EVOSS Act (RA 11234) applies to MGSP permitting, but RA 11234 §§13–16 timeframes are halved for MGSPs. Provisional authority (Notice/Acknowledgement) issued by ERC within 75 days of DOE award + MSC execution + receipt of complete application.

§20.3 / §26.5–26.7 (UC-ME): NPC exclusively collects UC-ME from DUs and disburses to eligible MGSPs. 45-day disbursement deadline from submission of complete documentary requirements.

§29.5 (MGSP exemptions): Exempt from RA 9136 §28 (public listing) and §45(a) (market share limitation).

§29.6 (End-user exemptions): End-users in off-grid unserved/underserved areas exempt from FiT allowance (RA 9513 §7) and universal charges (RA 9136 §34).

§30 (EPIMB): DOE to strengthen EPIMB for Act implementation within 180 days (pending DBM approval).

§31 (ERC Special Division): ERC must create dedicated Special Division for microgrid regulation.

§36 (Amendatory clause): Explicitly amends CA 146 §16(c) (Public Service Act), EO 172 §8 (ERB), RA 9136 §§28/43/45(a)/51(l)/59/70, RA 11234 §§13–16.
