Overview

DC2016-04-0005 formally elevated PESLP compliance to an explicit government policy, placing it on a par with other declared energy policies under RA 7638 (DOE Act) and EPIRA. The PESLP had operated since 1992 through product-specific standards issuances; this circular gave it an overarching policy declaration and a general prohibition on selling non-compliant products. Superseded by DC2020-06-0015 (PELP Guidelines, June 2020) under RA 11285 [DC2016-04-0005, §10, 2016-04-02].

PESLP Coverage at Time of Circular

Mandatory energy labeling had been in force since 1992 and expanded over time to cover [DC2016-04-0005, recitals, 2016-04-02]:

• Room air conditioners (since 1992, per PNS 396 Part 1:1995)
• Split-type air conditioners
• Refrigerators (5–8 cubic feet storage capacity)
• Self-ballasted fluorescent lamps (compact fluorescent lamps/CFLs)
• Linear fluorescent lamps
• Circular fluorescent lamps
• Fluorescent lamp ballasts (electronic and magnetic)

Key Provisions

Section 1 — Policy Declaration: Compliance by importers, manufacturers, distributors, and dealers with PESLP is hereby declared a government policy [DC2016-04-0005, §1, 2016-04-02].

Section 2 — Scope: All importers, manufacturers, distributors, and dealers of PESLP-covered household appliances, lighting products, motor vehicles, and other energy-consuming equipment [DC2016-04-0005, §2, 2016-04-02].

Section 3 — Prohibited Acts: Selling products not compliant with PESLP is prohibited [DC2016-04-0005, §3, 2016-04-02].

Section 4 — Reportorial Requirements: Covered entities must submit relevant information to DOE for estimating energy consumption and savings from PESLP [DC2016-04-0005, §4, 2016-04-02].

Section 7 — Implementing Guidelines: DOE-EUMB and ERTLS shall issue implementing guidelines (administrative, general technical, and per-product requirements) only after public consultation; effectivity and timelines to be mutually agreed with industry [DC2016-04-0005, §7, 2016-04-02].
