Context

Total household electrification was a declared Duterte administration target for 2022, aligned with the UN SDG 7 (universal energy access). Distribution utilities (DUs) and ailing electric cooperatives continued to underperform, hampering total electrification. The rapid development of microgrids, distributed energy resources (DERs), and alternative service providers created new options for unserved/unviable areas [EO 156, s. 2021, WHEREAS, 2021-12-09].

Key Provisions

§1 — DOE responsibilities:

  • §1.1 — Identify “Inadequately Served Areas” (unviable, unserved, underserved, poorly served areas within DU franchise areas)
  • §1.2 — Mandate all DUs to submit a Comprehensive Electrification Master Plan (CEMP) within 30 days, with detailed inventory, action plans, timelines, and budget
  • §1.3 — Take steps to electrify Inadequately Served Areas after Timeline for Satisfactory Service lapses; prioritize DOE-declared remote/unviable areas for alternative service providers
  • §1.7 — Promulgate rules for microgrid, DER, and alternative service provider entry [EO 156, s. 2021, §1, 2021-12-09]

§2 — ERC responsibilities:

  • Promulgate rules for full cost recovery for microgrid/DER facilities
  • Issue guidelines for registration of microgrids, DERs, and alternative service providers
  • Impose fines and penalties against non-compliant DUs; recommend franchise revocation to Congress [EO 156, s. 2021, §2, 2021-12-09]

§3 — NEA responsibilities and step-in rights transfer:

  • Submit report on ailing electric cooperatives within 30 days
  • Coordinate with DOE on distribution development
  • Power to exercise step-in rights and take over operations of ailing electric cooperatives (previously under NEA pursuant to RA 10531) transferred to the Office of the President [EO 156, s. 2021, §3, 2021-12-09]

§5 — Reporting: DOE report within 60 days on DU programs and timelines; follow-up report by DOE/ERC/NEA within 6 months thereafter [EO 156, s. 2021, §5, 2021-12-09].

Policy Notes

  • The transfer of NEA step-in rights to the Office of the President is the most legally significant provision — it centralizes the most coercive intervention power (EC takeover) at the highest executive level
