Context

RA 11234 (EVOSS Act, 2019) created an EVOSS Steering Committee to set up the EVOSS and streamline energy project permitting — but the Steering Committee had a statutory lifespan of only 2 years. It was dissolved by operation of law on March 30, 2021 [EO 143, s. 2021, WHEREAS ¶3, 2021-07-02].

Before dissolution, the Steering Committee passed Resolution No. 2021-03-003 recommending an EVOSS Task Group to oversee continued implementation of RA 11234 [EO 143, s. 2021, WHEREAS ¶5, 2021-07-02].

Key Provisions

§1 — ETG creation: The EVOSS Task Group (ETG) created to oversee continued implementation of RA 11234 and its IRR [EO 143, s. 2021, §1, 2021-07-02].

§2 — Composition:

  • Chairperson: Office of the President
  • Vice-Chairperson: DOE Secretary
  • Members: DA, DAR, DENR, DILG, DICT Secretaries + ERC Chair + NCIP Chair + NWRB Executive Director + Market Operator CEO + System Operator and TNP CEO
  • Non-voting: Power generation, transmission, and distribution sector representatives chosen by the DOE Secretary [EO 143, s. 2021, §2, 2021-07-02]

§3 — Functions: Exercises same powers as the former EVOSS Steering Committee (§11 of RA 11234), plus additional functions: (a) streamline agency processes and requirements; (b) ensure increasing EVOSS operationalization (integration, interoperability, online payment); (c) ensure compliance with RA 11234 timelines; (d) ensure deemed-approved compliance; (e) monitor and assess EVOSS performance; (f) promulgate guidelines [EO 143, s. 2021, §3, 2021-07-02].

§6 — ARTA relationship: ETG and Anti-Red Tape Authority (ARTA) to assist each other; RA 11032 is general law, RA 11234 is special law for energy projects [EO 143, s. 2021, §6, 2021-07-02].

§7 — Reporting: Annual report to the Office of the President on RA 11234 implementation [EO 143, s. 2021, §7, 2021-07-02].

Policy Notes

  • ETG is the institutional successor to the EVOSS Steering Committee, filling the governance vacuum created by the 2-year lifespan provision of RA 11234
  • EO 21 (s. 2023) directed EVOSS integration for offshore wind projects, operating through the same ETG/EVOSS Secretariat structure established here
