EO 30 (s. 2017): Creating the Energy Investment Coordinating Council (EICC)

This EO creates the EICC to streamline permitting for major energy projects of national significance. It is the institutional predecessor to the EVOSS statutory framework established under RA 11234 (2019).
Energy Projects of National Significance (EPNS) (§2)
Major energy projects (power generation, transmission, ancillary services) endorsed by DOE as projects of national significance, having at least one of: capital investment ≥PhP3.5 billion; significant economic development contribution; significant consequential economic impact; significant balance of payments impact; significant environmental impact; complex technical processes; or significant infrastructure requirements [EO 30, s. 2017, §2, 2017-06-28].
EICC (§3–4)
The Energy Investment Coordinating Council (EICC) constituted to harmonize, integrate, and streamline regulatory processes, requirements, and forms for energy investments — primarily for EPNS.
Composition:
- Chair: DOE representative
- Members: DENR (BMB/EMB/FMB/LMB), NEA, NGCP, NPC, TransCo, DOF (BOC/BIR), DOJ (BI), DOTr (CAAP/MARINA/PCG/PPA), HLURB, PCSD, and such other agencies as the Council deems necessary

EICC Functions (§5)
- Establish simplified and harmonized approval processes for EPNS
- Prepare rules and procedures for resolving inter-agency conflicts
- Maintain web-based monitoring database for energy investment applications
- Create inter-agency subcommittees as needed
- Submit quarterly progress reports to the Office of the President

Processing Baselines for EPNS (§7)
Presumption of Prior Approvals: Agencies act on their own jurisdiction without waiting for other agencies’ action.
30-day action rule: Agencies must act on complete applications within 30 days (as specified by EICC). If an agency fails to act within 30 days: deemed approved within 5 working days of that lapse.

ECC Procedures for EPNS (§8)
DENR to formulate Environmental Compliance Certificate (ECC) guidelines for EPNS consistent with the 30-day baseline, to be submitted to the Office of the President within 60 days [EO 30, s. 2017, §8, 2017-06-28].
